NRC INSPECTION REPORT NO. 70-1151/98-10 AND NOTICE OF VIOLATION

Dear Mr. Allen:

This letter refers to the inspection conducted on December 7-11,1998, at the Westinghouse facility. The enclosed report presents the results of this inspection.

Based on the results of this inspection, the NRC has determined that violations of NRC requiremeras occurred. These violations are cited in the enclosed Notice of Violation (Notice) and the circumstances surrounding them are described in detail in the subject inspection report.

The violations involve procedural inadequacies, failure to follow ooerating procedures, and failure to ensure the physical condition of radioactive material shyping containers. The violations are of a concern because they indicate a continuing trend of inattentiveness to procedural requirements and details.

You are required to respond to this letter and should follow the instructions specified in the enclosed Notice when preparing your response. The NRC will use your response, in part, to determine whether further enforcement action is necessary to ensure compliance with regulatory requirements.

Regarding your shipment of a radioactive waste package containing a hole (Violation C), the i

NRC has concluded that information regarding the reason for the violation, the corrective actions taken and planned to correct the violation and prevent recurrence is already adequately addressed on the docket in the enclosed inspection report. Therefore, you are not required to respond to that portion of the Notice unless the description therein does not accurately reflect your corrective actions or your position. In that case, or if you choose to provide additional information, you should follow the instructions specliled in the enclosed Notice.
