Dear Mr. Sanders:

l This letter serves as formal notification of the transference of your low enriched uranium fuel fabrication facility from participation under Article 39(b) of the US/IAEA Safeguards Agreement to Article 2(a) of the Protocol to the Agreement as evidenced by the enclosed (Enclosure A) Transitional Facility Attachment No. Sa dated August 31, 1988.

In order to implement the transition, current License Condition 3.1 (Section 3.0---

International Safeguards) of Amendment SG-3 to your License no. SNM-1107 is hereby revised, effective upon receipt of this letter, as stated in Enclosure B to this letter. In addition to revised License Condition 3.1, the enclosure also contains License Conditions 3.1.1 through 3.1.7 which provide clarification ,

(at your request) to explain the meaning and/or intent of certain Codes of your  !

Transitional Facility Attachment No. Sa dated August 31, 1988. Enclosure B to this letter effectively replaces Section 3.0, in its entirety, of Safeguards Amendment SG-3 dated April 1, 1987. (All other conditions remain as stated or as applicable.)

Please note that the markings on the enclosed Transitional Facility Attachment that read " Safeguards Confidential" are of IAEA origin and have no connotation in regard to any domestic security classification.

It has been determined that the enclosed Transitional Facility Attachment No. Sa dated August 31, 1988 contains information of the type specified in 10 CFR 2.790(d)(1), such information is deemed to be commercial or financial within the meaning of 10 CFR 9.17(a)(4) and shall be withheld from public disclosure unless subject to the provisions of 10 CFR 9.23.
