NRC INSPECTION REPORT NO. 70-1151/98-10 i

Dear Mr. Allen:

Thank you for your response of January 29,1999, to our Notice of Violation issued on December 31,1998, concerning activities conducted at the Columbia Nuclear Fuel Plant. We have evaluated your response and found that it meets the requirements of 10 CFR 2.201.

After reviewing your letter, we have made the following assessment. Violation A of the December 31,1998, Notice of Violation stated that storage of nuclear materials were not being i conducted in accordance with approved procedures in that uranium oxide sample containers were routinely stored on an engineered storage rack without being authorized by area operating procedures or nuclear criticality safety postings. In your response letter of January 29,1999, you state that, "During the inspection, the inspectors were incorrectly told that placing the cups with 10 gram samples into the storage racks was not covered by procedure. Subsequent to the close of the inspection, however, it was determined that there is an operating procedure (COP-815002, Revision 23, August 1,1997) that specifically addresses this."

Based on this new information, we have concluded that the use of the storage racks for the sample cups was addressed by the procedure; therefore, this aspect of the violation is withdrawn. However, as noted in the original Notice and in your response the nuclear criticality safety posting did not address this configuration. Thus, the Violation remains valid with respect to this latter issue and we will adjust our records regarding Procedure COP-815002 accordingly.

As stated in the subject inspection report and your response to the Notice of Violation, actions '

were completed to correct the posting prior to the end of the inspection. Thus, no further response is required to address the revised violation.

Your corrective action associated with Violation B will be reviewed during future inspections.
