Dear Ms. Kugler:

RETRACTION OF DISCHARGE REPORT PUBLIC SERVICE ELECTRIC AND GAS COMPANY HOPE CREEK GENERATING STATION CASE NO. 92-09-24-1529-50 On September 24, 1992, PSE&G reported a discharge of approximate 1.y one pint of oil to a stone surfaced area in the Hope Creek Generating Station yard, northwest of the reactor building. The discharge was assigned Case No. 92-09-24-1529-50.

Upon investigation of the discharge and review of applicable regulations, PSE&G has determined that this discharge was to an impermeable surface as defined in NJAC 7:lE-1.6. All oil was cleaned up immediately and removed prior to any* escape into the waters or lands of the State in accordance with the requirements of the definition of " leak". It is PSE&G's interpretation of the regulations that as this incident involved a leak onto a surfaced area and was cleaned up immediately as provided in NJAC 7:1E-1.6, it is exempt from this reporting requirement.

PSE&G believes and maintains that it acted in accordance with the intent of NJAC 7:1E-5.3 which requires all major facilities to notify NJDEPE of discharges of potentially hazardous substances in any concentration.
