Dear Chairman Miller:

Enclosed herewith are proposed Subpoenas to compel the appearance of seven individuals for depositions on July 1, 1982. We have also enclosed Notice of Depositions requesting same. All of the Notices were served yesterday or this morning. Each of the individuals for which a Sub-poena is enclosed was identified as a witness CASE intends to call in support of its allegations for Contention 5 (June 23, 1982 CASE Proposed Witness List) .

We request that you sign the proposed Subpoenas to - --

permit us to serve them prior to the planned depositions.

We have discussed this matter with counsel for the inter-venor and, while CASE has indicated to Applicants that it l- does not expect any problems in having these witnesses appear for their depositions, it also stated that it does not control them and cannot compel their attendance.

Should.these witnesses fail to attend their depositions, it would be very difficult for us then to request Sub-poenas, complete service and depose the witnesses in time to satisfy the July 7, 1982 deadline by which time all depositions must be completed.

We have enclosed checks payable to each witness for travel costs and witness fees. They will, of course, be given the checks when the subpoenas are served. Service will be made by a private party as indicated on the pro-las.
