'Seabrook operating license case.

I:am also writing, on behalf of Intervenors NECNP, the Mass-achusetts Attorney General, and the Seacoast Anti-Pollution j League,- to remind you of your obl-igation to fully comply with the .j

' Government.in~the Sunshine Act in scheduling any further Commis-sion meetings on the Seabrook operating license case. The Act 1 commands the Commission, inter alia,'to give at least one week's  :

notice of a meeting, including the time and place, the subject y matter of the meeting, whether it is to be opsn or closed to the  !

public, and the name and phone number of the official designated by-the'NRC to' respond to requests for information about the meet- (

ing.- 5 U.S.C. 5 552b(e) (1) .

.This request is necessitated by the Commission's long hiu-tory of noncompliance with the Sunshine Act. In the past, the Seabrook Intervenors have not consistently received a week's notice of Commiss Sn meetings on Seabrook. Moreover, other than being told in general terms that a scheduled meeting concerned the Seabrook nuclear power plant, we have never received notice of the specific subject matter of any of the Commission's meet-ings. In the'past, no contact person has been designated; and when our inquiries led us to a knowledgeable person, that indi-vidual'. typically refused to divulge the subject matter of the '

meeting.

In order to determine whether to attend upcoming Commission meetings on Seabrook, and to anticipate whether and what type of

appeal may be necessary following a Commission vote, the Inter-venors must be informed in advance of the specific subjects that will be considered by the Commissioners at their meetings.

We understand that the Commission does not intend to vote on any items at the January 18th meeting. However, the Inter-venors seek notice of whether and when the commission intends to rule on a number of pleadings now pending before it,

_ including the Intervenors' Motion to vacate Those Portions of LBP-89-32 Authorizing Issuance of a Seabrook Operating License, dated November 13, 1989; Intervenors' Motion for Reconsideration of Commission's November 16 Order, dated November 17, 1989; Intervenors' and Applicants' petitions for review of ALAB-924; Intervenors' Supplemental Motion and Memorandum in Support of November 13 Motion to Revoke and Vacate the November 9 License Authorization, dated December 1, 1989; Intervenors' Application for a Stay of LBP-89-32, dated December 1, 1989; and immediate effectiveness comments filed by NECNP, SAPL, and the Massachusetts Attorney General.
