By letter dated August 12, 2004, Westinghouse submitted an affidavit dated August 12, 2004, executed by you, requesting that the documents listed below be withheld from public disclosure pursuant to Title 10 of the Code of Federal Regulations (10 CFR) Section 2.390. These documents were provided to the U.S. Nuclear Regulatory Commission staff for review and audit.

10. ECS03-001, Waterford 3 3716 MWt Power Uprate Groundrules On August 16, 2004, during a telephone call, Mr. G. Hess of Westinghouse had instructed that, after the review, these documents could be either sent back to Westinghouse or destroyed in place of a determination that the submitted information sought to be withheld contains proprietary commercial information.

Accordingly, this is to inform you that all the documents listed above have been destroyed.
