Dear Joseph Sullivan:

On June 30, 2023, the U.S. Nuclear Regulatory Commission (NRC) completed an inspection at Waterford Steam Electric Station, Unit 3. On July 31, 2023, the NRC inspectors discussed the results of this inspection with you and other members of your staff. The results of this inspection are documented in the enclosed report.

No NRC-identified or self-revealing findings were identified during this inspection.

A licensee-identified violation which was determined to be of very low safety significance is documented in this report. We are treating this violation as a non-cited violation (NCV)

consistent with Section 2.3.2 of the Enforcement Policy.

The U.S. Nuclear Regulatory Commission (NRC) continued monitoring the licensees performance by conducting an integrated inspection at Waterford Steam Electric Station, Unit 3, in accordance with the Reactor Oversight Process. Unit 3 operated at or near rated thermal power for the entire inspection period.

INSPECTION SCOPES

Inspections were conducted using the appropriate portions of the inspection procedures (IPs) in effect at the beginning of the inspection unless otherwise noted. Currently approved IPs with their attached revision histories are located on the public website at http://www.nrc.gov/reading-rm/doc-collections/insp-manual/inspection-procedure/index.html. Samples were declared complete when the IP requirements most appropriate to the inspection activity were met consistent with Inspection Manual Chapter (IMC) 2515, Light-Water Reactor Inspection Program - Operations Phase. The inspectors performed activities described in IMC 2515, Appendix D, Plant Status, observed risk significant activities, and completed on-site portions of IPs. The inspectors reviewed selected procedures and records, observed activities, and interviewed personnel to assess licensee performance and compliance with Commission rules and regulations, license conditions, site procedures, and standards.

71111.01 - Adverse Weather Protection

Seasonal Extreme Weather Sample (IP Section 03.01) (1 Sample)

(1) The inspectors evaluated readiness for seasonal extreme weather conditions prior to the onset of hurricane season for the following systems: emergency diesel generator system, ultimate heat sink, emergency feedwater system, and startup transformers on May 5, 2023.

The inspectors evaluated the biennial emergency plan exercise conducted on June 21, 2023. However, as of the end of the 2nd quarter 2023, the licensee had not completed its critique process for the exercise. As such, the inspectors had not completed the full evaluation of the exercise and the critique process. The inspectors will complete the inspection in the 3rd quarter, and the results of the inspection will be documented in NRC Inspection Report 05000382/2023003.

71114.04 - Emergency Action Level and Emergency Plan Changes

INSPECTION RESULTS

Licensee-Identified Non-Cited Violation 71111.05 This violation of very low safety significance was identified by the licensee and has been entered into the licensee corrective action program and is being treated as a non-cited violation, consistent with Section 2.3.2 of the Enforcement Policy.

Violation: The Waterford Steam Electric Station, Unit 3 Renewed Facility Operating License, section 2.C(9), requires that the licensee implement and maintain in effect all provisions of the approved fire protection program. The approved fire protection program as described by procedure EN-DC-161, Control of Combustibles, revision 24, required that continuous administrative fire watches be established prior to the introduction of any non-exempt transient combustible materials into designated Level 1 areas.

Contrary to the above, from March 11 to April 25, 2022, the licensee failed to establish fire watches in accordance with the approved fire protection program. Specifically, the licensee failed to establish continuous administrative fire watches in Level 1 designated areas containing non-exempt transient combustible materials. On April 25, 2022, the licensee entered condition report CR-WF3-2022-03147 into their corrective action program which states none of the required administrative continuous fire watches or hourly fire watches were found on station. These watches were required for transient combustible permits that have been open as early as March 11, 2022, and were still in place that day. The condition report notes four fire areas with Level 1 combustible control zones, as defined in attachment 4 of EN-DC-161, where fire watches were not identified:

- RAB 7, relay room

- RAB 8A, switchgear room A

- RAB 8B, switchgear room B

- RCB, reactor containment building

Section 7.5 of EN-DC-161, requires a continuous fire watch to be established in accordance with procedure EN-OP-139, Fire Watch Program, revision 6, as a minimum compensatory action prior to the introduction of any non-exempt transient combustible materials into designated Level 1 areas. The inspectors reviewed this condition report and identified a partial loss of fire detection and suppression from April 14 to 16, 2022, for fire zones RAB 8A and RAB 8B, that did not appear to have appropriate continuous fire watches. The inspectors requested documentation from the licensee to validate that these fire watches were performed. No conclusive documentation was found that demonstrated the fire watches were performed.

Significance/Severity: Green. The inspectors assessed the significance of the finding using IMC 0609.04, Initial Characterization of Findings, and IMC 0609, appendix F, attachment 1, and determined the finding to be of very low safety significance (Green) because the affected areas were protected with automatic detection and suppression.

The inspectors verified no proprietary information was retained or documented in this report.

On May 18, 2023, the inspectors presented the emergency preparedness exercise scenario inspection results to G. Taylor, Senior Project Manager, Emergency Preparedness, and other members of the licensee staff.

On June 29, 2023, the inspectors presented the EP performance indicator verification and emergency plan change review inspection results to N. Lawless, Director, Maintenance, and other members of the licensee staff.

On July 17, 2023, the inspectors presented the integrated inspection first exit inspection results to J. Sullivan, Site Vice President, and other members of the licensee staff.

On July 31, 2023, the inspectors presented the integrated inspection results to J. Sullivan Site Vice President and other members of the licensee staff.
