On January 14, 2015, members of the U.S. Nuclear Regulatory Commission (NRC) staff met with representatives of the Diablo Canyon Power Plant to discuss the apparent violation with an associated finding involving the failure to obtain prior approval for an emergency plan change which decreased the effectiveness of the emergency plan as documented in NRC Inspection Report 05000275/2014502 and 05000323/2014502 (ML14335A774). The purpose of the regulatory conference was to discuss your position, with respect to the facts and assumptions used by the NRC to make our preliminary safety significance determination, and to allow you to present any new information that may assist us in arriving at the final significance of the finding.

Your staff also communicated the corrective actions taken which included adding an emergency preparedness supervisor position for additional oversight; adding metrics to monitor program health; strengthening procedure instructions, training, and qualifications for performing change evaluations; and adding a protective action recommendation bases document to the site emergency plan. Additionally, your staff initiated an Emergency Preparedness Licensing Basis Verification Project to reassess all changes to its emergency plan since its original approval by the NRC. Additionally, during the Regulatory Conference, your staff presented several factors for NRC consideration to exercise enforcement discretion.
