SUMMARY

OF NOVEMBER 24, 2020, PRE-SUBMITTAL TELECONFERENCE WITH PACIFIC GAS AND ELECTRIC COMPANY REGARDING A PERMANENTLY DEFUELED TECHNICAL SPECIFICATION LICENSE AMENDMENT REQUEST (EPID L-2020-LRM-0101)

On November 24, 2020, a Category 1 public teleconference was held between the U.S. Nuclear Regulatory Commission (NRC) and representatives of the Pacific Gas and Electric Company (the licensee). The purpose of the pre-submittal teleconference was to discuss a proposed license amendment request (LAR) to revise the Diablo Canyon Nuclear Power Plant, Units 1 and 2 (Diablo Canyon) Technical Specifications (TSs) to reflect a permanently defueled condition. The licensees presentation slides are available in the Agencywide Documents Access and Management System (ADAMS) at Accession No. ML20310A279. The meeting notice and agenda, dated November 6, 2020, are available in ADAMS at Accession No. ML20328A210. A list of attendees is enclosed.

During the meeting, Pacific Gas and Electric Company stated its intent to permanently cease operations of Diablo Canyon, Units 1 and 2, upon expiration of the operating licenses. The licenses expire on November 2, 2024, and August 26, 2025, respectively. Thus, Unit 1 would cease operation a year earlier than Unit 2. Because both units share the same TSs, the licensee indicated that it would implement the permanently defueled TSs after Unit 2 (the last unit) has ceased operation. The proposed LAR was part of the licensees decommission planning activities.

The licensee indicated it did not submit a certified fuel handler program for NRC approval because the outcome of the decommission rulemaking could make it unnecessary. Addressing comments from the NRC staff, the licensee clarified information in its slides, including that the American Society of Mechanical Engineers tanks include liquid hold-up and waste gas decay tanks (slide 6). The licensee gave examples of minor and major changes in the general design criteria (GDC) (slide 7). GDC-66 for fuel storage would be a minor change because there would be no new fuel. GDC-4 for shared systems would be a major change because there would be less systems after decommissioning. The licensee also indicated that the Diablo Canyon TSs contains an Appendix D of conditions that have been previously completed and would be deleted (slide 10). The licensee clarified that it was evaluating its options for fire protection in decommissioning (slide 18). The NRC staff commented that Pilgrim Nuclear Power Station and Vermont Yankee Nuclear Power Station were also precedents (slide 20).

The licensee indicated that it plans to submit the permanently defueled TS LAR in December 2020.

Six members of the public were in attendance. Two members of the public provided comments in opposition to Diablo Canyon being shut down because of the need for power, grid stability, and the environment. One of them also provided an e-mail with comments before the meeting (ADAMS Package Accession No. ML20328A296).

No regulatory decisions were made at the meeting.
