OF REGULATORY CONFERENCE TO DISCUSS SAFETY SIGNIFICANCE OF DIABLO CANYON POWER PLANT PROTECTIVE ACTION RECOMMENDATIONS FOR AREAS OF THE OCEAN FINDING

Dear Mr. Halpin:

On January 14, 2015, members of the U.S. Nuclear Regulatory Commission (NRC) staff met with representatives of the Diablo Canyon Power Plant to discuss the apparent violation with an associated finding involving the failure to obtain prior approval for an emergency plan change which decreased the effectiveness of the emergency plan as documented in NRC Inspection Report 05000275/2014502 and 05000323/2014502 (ML14335A774). The purpose of the regulatory conference was to discuss your position, with respect to the facts and assumptions used by the NRC to make our preliminary safety significance determination, and to allow you to present any new information that may assist us in arriving at the final significance of the finding.

During the meeting, your staff described your assessment of the significance of the finding and the corrective actions taken to resolve it, including the root cause evaluation of the finding.

Specifically, your staff determined that it did not effectively compare changes to emergency plan implementing procedures to NRC regulations and emergency plan requirements, and performed less than adequate evaluations for determining decreases in effectiveness. Your staff also communicated the corrective actions taken which included adding an emergency preparedness supervisor position for additional oversight; adding metrics to monitor program health; strengthening procedure instructions, training, and qualifications for performing change evaluations; and adding a protective action recommendation bases document to the site emergency plan. Additionally, your staff initiated an Emergency Preparedness Licensing Basis Verification Project to reassess all changes to its emergency plan since its original approval by the NRC. Additionally, during the Regulatory Conference, your staff presented several factors for NRC consideration to exercise enforcement discretion. A copy of the handout you provided at this meeting can be found in the NRCs Agencywide Documents Access and Management System (ADAMS) (ML15014A223).

E. Halpin The NRC staff asked questions during the Regulatory Conference to clarify its understanding of the information presented. The NRC requested that you provide information regarding the findings of the Emergency Preparedness Licensee Basis Verification Project. The NRC will continue to review the information that you provided during the regulatory conference and the subsequent information that was requested in order to reach a final significance determination.

We are developing our final risk significance and will issue a final significance determination letter in February.

Meeting attendance rosters for Region IV and teleconference are provided as enclosures to this letter. This regulatory conference was video-recorded and transcribed. The video and copy of the transcription (ML15020A010) will be made available and placed into the NRCs Agencywide Documents Access and Management System (ADAMS). This Category 1 public meeting was attended telephonically by 14 members of the public, 5 members from other government agencies, and other staff of the NRC, licensee, and nuclear industry.

In accordance with 10 CFR 2.390 of the NRCs Rules of Practice, a copy of this letter and its enclosures will be available electronically for public inspection in the NRCs Public Document Room or from the Publicly Available Records (PARS) component of the NRCs ADAMS.
