DETERMINATION OF ACCEPTABILITY AND SUFFICIENCY FOR DOCKETING AND NOTICE OF OPPORTUNITY TO REQUEST A HEARING REGARDING PACIFIC GAS AND ELECTRIC COMPANYS APPLICATION FOR LICENSE RENEWAL
Dear Ms. Gerfen:
By letter dated November 7, 2023 (Agencywide Documents Access and Management System Accession No. ML23311A154), Pacific Gas and Electric Company submitted an application for the renewal of Facility Operating License Nos. DPR-80 and DPR-82 for Diablo Canyon Nuclear Power Plant (DCPP), Units 1 and 2 to the U.S. Nuclear Regulatory Commission (NRC). By letter dated November 14, 2023 (ML23293A105), and Federal Register Notice dated November 20, 2023 (88 FR 80780), the NRC noticed the receipt and availability of this application.
The NRC staff has determined that the application contains sufficient information for the agency to formally docket the application and begin its safety and environmental reviews. Docketing the application does not preclude the NRC from requesting additional information as the reviews proceed, and it does not indicate whether the NRC will renew the licenses.
The NRC staffs acceptance review of an application is intended to identify whether the application is reasonably complete and conforms to the timing and information requirements in applicable regulations. The NRC staff reviewed the DCPP license renewal application following the guidance in NUREG-1800, Revision 2, Standard Review Plan for Review of License Renewal Applications for Nuclear Power Plants, and NUREG-1555, Supplement 1, Revision 1, Standard Review Plans for Environmental Reviews for Nuclear Power Plants, to determine if the application is sufficient and acceptable for docketing in accordance with Title 10 of the Code of Federal Regulations (10 CFR) Sections 2.101, Filing of application, 51.45, Environmental report, 51.53(c), Operating license renewal stage, 54.19, Contents of applicationgeneral information, 54.21, Contents of applicationtechnical information, 54.22, Contents of applicationtechnical specifications, and 54.23, Contents of applicationenvironmental information. The NRC staff also conducted four pre-submittal meetings regarding the DCPP license renewal application, as documented in letters dated January 6, 2023 (ML23004A149),
June 1, 2023 (ML23143A226), June 23, 2023 (ML23172A196), and September 26, 2023 (ML23265A190).
P. Gerfen Based on the results of the NRC staffs sufficiency review, the staff has concluded that the DCPP license renewal application is acceptable for docketing. Given the lesser scope and depth of the acceptance review as compared to a detailed technical review, the NRC staffs determination does not preclude requests for additional information or topic-specific audits.
During the NRC staffs detailed technical review, there may be instances identified in which issues that impact the staffs ability to complete the detailed technical review are identified. You will be notified by separate correspondence if any further information is needed to support the NRC staffs detailed technical review.
The NRC staff is in the process of formulating its projected review schedule and resource estimates for the DCPP license renewal application to complete the reviews required by 10 CFR Parts 51, Environmental Protection Regulations for Domestic Licensing and Related Regulatory Functions, and 54, Requirements for Renewal of Operating Licenses for Nuclear Power Plants. The NRC staff will provide you with its projected review schedule and resource estimates by separate correspondence.
Enclosed is a copy of the notice related to the DCPP license renewal application that is being sent to the Office of the Federal Register for publication. This notice announces the acceptance for docketing of and the opportunity to request a hearing and to petition for leave to intervene on the application. The NRCs regulations require a minimum of 60 days to request a hearing and petition for leave to intervene. Here, in consideration of the holiday season, the NRC staff is extending the time period for requesting a hearing and petitioning for leave to intervene to 75 days from the date of the publication of the notice in the Federal Register.
