Dear Representative Donalds:

On behalf of the U.S. Nuclear Regulatory Commission (NRC), I am responding to your November 3, 2023, letter regarding the request submitted by Friends of the Earth and San Luis Obispo Mothers for Peace for the NRC to order the immediate closure of Diablo Canyon Nuclear Power Plant, Unit 1.

The Secretary of the Commission referred the request to the NRC staff for consideration under Title 10 of the Code of Federal Regulations (10 CFR) Section 2.206, and the staff is currently evaluating the request. The staff formed a Petition Review Board that includes agency staff with technical expertise applicable to the concerns raised . The Petition Review Board is evaluating the concerns to determine if action under 10 CFR 2.206 is warranted. The staff is committed to issuing a final decision on this request in a timely manner.
