ENCLOSURE 1 NOTICE OF VIOLATION Omaha Public Power District Docket No.: 50-285 Fort Calhoun Station License No.: DPR-40 l l

During an NRC inspection conducted on April 6-10,1998, a violation of NRC requirements was identified. In accordance with the " General Statement of Policy and Procedure for NRC Enforcement Actions," NUREG-1600, the violations are listed below:

10 CFR 20.1003 defines a high radiation area as an area accessible to individuals, in which radiation levels could result in an individual receiving a dose equivalent in v. cess of 0.1 rem (100 millirems) in 1 hour1.157407e-5 days <br />2.777778e-4 hours <br />1.653439e-6 weeks <br />3.805e-7 months <br /> at 30 centimeters from the radiation source or from any surface that the radiation penetrates.

Technical Specification 5.11 requires, in part, that entrance into high radiation areas be controlled by radiation work permits.

Radiation Work Permit 98-0011, " Routine Operations Duties Throughout Containment,"

Revision 0, requires continuous radiation protection coverage for entry into restricted high radiation areas (high radiation areas with dose rates greater than 1000 millirems / hour)

Contrary to the above, on April 7,1998, an individual working in accordance with Radiation Work Permit 98-0011 entered a restricted high radiation area in Steam Generator Bay B without continuous radiation protection coverage.

This is a Severity Level IV violation (Supplement IV)(50-285/9806-05).

i Pursuant to the provisions of 10 CFR 2.201, Omaha Public Power District is hereby required to j submit a written statement or explanation to the U.S. Nuclear Regulatory Commission, ATTN: l Document Control Desk, Washington, D.C. 20555 with a copy to the Regional Administrator, {

Region IV,611 Ryan Plaza Drive, Suite 400, Arlington, Texas 76011, and a copy to the NRC l Resident inspector at the facility that is the subject of this Notice, within 30 days of the date of the letter transmitting this Notice of Violation (Notice). This reply should be clearly marked as a

" Reply to a Notice of Violation" and should include for each violation: (1) the reason for the  ;

violation, or, if contested, the basis for disputing the violation or severity level, (2) the corrective steps that have been taken and the results achieved, (3) the corrective steps that will be taken to l avoid further violations, and (4) the date when full compliance will be achieved. Your response '

may reference or include previous docketed correspondence, if the correspondence adequately i addresses the required response. If an adequate reply is not received within the time specified in this Notice, an order or a Demand for information may be issued as to why the license should not be modified, suspended, or revoked, or why such other action as may be proper should not be taken. Where good cause is shown, consideration will be given to extending the response time.
