ENCLOSURE NOTICE OF VIOLATION

50-285 Fort Calhoun Station License No.: DPR-40 i

During an NRC inspection conducted on November 2-6,1998, a violation of NRC requirements was identified, in accordance with the " General Statement of Policy and Procedure for NRC Enforcement Actions," NUREG-1600, the violation is listed below:

Technical Specification 5.8.1.a requires, in part, that written procedures be established, l

implemented, and maintained that meet or exceed the minimum requirements of l

Appendix A of Regulatory Guide 1.33.

Regulatory Guide 1.33 Appendix A, Sections 7.e. 3 and 9. requires procedures for airbome radioactivity monitoring and the ALARA program, respectively.

Section 3.16.2 of Procedure RP-204, " Radiological Area Controls," Revision 25, states, airborne radioactivity areas are posted at 0.3 DAC.

Section 7.4.4.8. of Procedure RP-307,"Use and Control of Temporary Lead Shielding,"

i Revision 6., states, a TSR (temporary shielding request) tag is received from the ALARA l

(section) and attached to the shielding in a visible location by workers during or soon l

af ter (the) shielding installation.

l Contrary to the above, on November 3 and 4,1998, the inspector identified the following items.

l From approximately 4:45 a.m. to 11:45 a.m. on April 23,1998, room 13 on l

elevation 989 foot of the auxiliary building was not posted as an airborne

)

l radioactivity area when airborne radioactivity sample results revealed that the l

airborne radioactivity was greater than 0.3 DAC.

From approximately 6:50 p.m. to 7:50 p.m. on May 6,1998, the area surrounding spray control valve "RC 374" on elevation 1045 foot in the reactor containment building was not posted as an airborne radioactivity area when airborne radioactivity sample results revealed that the airborne radioactivity was greater than 0.3 DAC.

the radwaste building was not posted as an airborne radioactivity area when i

airborne radioactivity sample results revealed that the airborne radioactivity was greater than 0.3 DAC.

On the morning of November 2,1998, temporary shielding request tags were not i

attached to temporary lead shielding that was installed on the roof of room 506 in the radwaste building.

i l This is a Severity Level IV violation (Supplement IV ) (50-285/9824-01),

i The NRC has concluded that information regarding the reason for the violation, the corrective actions taken and planned to correct the violation and prevent recurrence and the date when full compliance will be achieved are already adequately addressed on the docket in the i

enclosed inspection report. However, you are required to submit a written statement or explanation pursuant to 10 CFR 2.201 if the description therein does not accurately reflect your corrective actions or your position. In that case, or if you choose to respond, clearly mark your response as a " Reply to a Notice of Violation," and send it to the U.S. Nuclear Regulatory Commission, ATTN: Document Control Desk, Washington, D.C. 20555 with a copy to the Regional Administrator, Region IV,611 Ryan Plaza Drive, Suite 400, Arlington, Texas 76011, and a copy to the NRC Resident inspector at the facility that is the subject of this Notice, within 30 days of the date of the letter transmitting this Notice of Violation (Notice).

Director, Office of Enforcement, United States Nuclear Regulatory Commission, Washington, DC 20555-0001.

Because your response, if you choose to provide one, will be placed in the NRC Public Document Room (PDR), to the extent possible, it should not include any personal privacy, proprietary, or safeguards information so that it can be placed in the PDR without redaction.
