p APPENDIX A NOTICE OF VIOLATION Omaha Public Power District Docket: 50-285 Fort Calhoun Station License: DPR-40 During an NRC inspection conducted October 11-31, 1989, a violation of NRC requirements was identified. The violation involved the failure to comply with the Technical Specification (TS) limiting condition for operation (LCO) for two inoperable reactor protection system (RPS) channels.

In accordance with the

" General Statement of Policy and Procedure for NRC Enforcement Actions,"

10 CFR Part 2, Appendix C (1989) (Enforcement Policy), the violation is listed below:

Failure to Comply With the TS LCO for the Inoperability of Two RPS Chennels TS 2.15, Table 2-2, Item 2 states, in part, that if two RPS channels are declared inoperable, load shall be reduced to 70 percent or less of rated power.

Contrary to the above, the licensee did not fully comply with the requirements of TS 2.15, in that the licensee did not, in a timely manner, reduce plant power to 70 percent or less of rated power after declaring two RPS channels inoperable.

This is a Severity Level IV violation.

Since immediate corrective actions were taken and the Omaha Public Power District has provided written commitments as discussed in a meeting with NRC management, no response is required.
