ENCLOSURE 1 NOTICE OF VIOLATION I

i During an NRC inspection conducted May 12-16,1997, a violation of NRC requirements i

'was identified. In accordance with the " General Statement of Policy and Procedure for NRC Enforcement Actions," NUREG 1600, the violation is listed below:

10 CFR 73.57(d)(1) requires, in part, licensees to submit one legible fingerprint card i

for each individual requiring unescorted plant access.

Contrary to the above, on August 27,1996, the licensee identified that a legible fingerprint card had not been submitted for an employee requiring unescorted plant access. Specifically, an employee's fingerprint card, submitted on March 5,1990, was categorized by the FBI as an " illegible print" and was returned to the licensee.

No action was taken at that time by the licensee to refingerprint the employee until this issue was identified by the inspector on May 14,1997.

i This is a Severity Level IV violation (Supplement Ill) (50-285/9708-02).

a The NRC has concluded, that information regarding the reason for the violation, the i

corrective actions taken and planned to correct the violation and prevent recurrence and the date when full compliance will be achieved is already adequately addressed in the enclosed report. However, you are required to submit a written statement or explanation pursuant to 10 CFR 2.201, if the description therein does not accurately reflect your corrective actions or your position. In that case, or if you choose to respond, clearly mark your response as a " Reply to a Notice of Violation," and send it to the U.S. Nuclear Regulatory Commission, ATTN: Document Control Desk, Washington, D.C. 20555 with a copy to the Regional Administrator, Region IV,611 Ryan Plaza Drive, Suite 400, Arlington, Texas 76011, and a copy to the NRC Resident inspector at the facility that is the subject of this Notice, within 30 days of the date of the letter transmitting this Notice of Violation (Notice).

Because your response will be placed in the NRC Public Document Room (PDR), to the extent possible, it should not include any personal privacy, proprietary, or safeguards information so that it can be placed in the PDR without redaction. However, if you find it necessary to include such information, you should clearly indicate the specific information that you desire not to be placed in the.PDR, and provide the legal basis to support your request for withholding the information from the public.
