ENCLOSURE 1 NOTICE OF VIOLATION Omaha Public Power District Docket No.- 50-285 Fort Calhoun Station License No.: DPR-40 During an NRC inspection conducted on May 19-23, 1997, one violation of NRC requirements was identified. In accordance with the " General Statement of Policy and Procedure for NRC Enforcement Actions," NUREG-1600, the violation is listed below:

Technied Specification 5.8.1 requires, in part, that written procedures be established, implemented, and maintained covering the applicable procedures recommended in Appendix A of Regulatory Guide 1.33, Revision 2, February 1978.

Regulatory Guide 1.33, Appendix A, recommends, in part, that procedures should ,

be written covering administrative procedures for safe operation.

Standing Order SO-O ' .evision 31, " Conduct of Operations," requires in i Step 12.1.2B that if while performing a procedure it is discovered that the i anticipated response was not received, initiate a temporary or permanent change in  !

accordance with Standing Order G-30, " Procedure Change and Generation. )

l Contrary to the above, the licensee did not properly implement the administrative procedure applicable to the activity in that on May 12,1997, the licensee did not initiate a procedure change as required when the governing Procedure OP-2A,

" Plant Startup," did not specify actions to be taken if all Group 4 control rods were withdrawn without reaching criticality.

This is a Severity Level IV violation (285/9701101) (Supplement 1).

i Purcuant to the provisions of 10 CFR 2.201, Omaha Public Power District is hereby I required to submit a written statement or explanation to the U.S. Nuclear Regulatory Commission, ATTN: Document Control Desk, Washington, D.C. 20555 with a copy to the Regional Administrator, Region IV,611 Ryan Plaza Drive, Suite 400, Arlington, Texas 7o011, and a copy to the NRC Resident Inspector at the faniity that is the subject of this Notice, within 30 days of the date of the letter transmitting this Notice of Violation (Notice). This reply should be clearly marked as a " Reply to a Notice of Violation" and should include for each violation: (1) the reason for the violation, or, if contested, the basis for disputing the violation, (2) the corrective steps that have been taken and the results achieved, (3) the corrective steps that will be taken to avoid further violations, and (4) the date when full compliance will be achieved. Your response may reference or include previous docketed correspondence, if the correspondence adequately addresses the required response. If an adequate reply is not received within the time specified in this .

Notice, an order or a Demand for information may ta issue:i as to why the license should l not be modified, suspended, or revoked, or why such other action as may be proper should not be taken. Where good cause is shown, consideration will be give to extending the response time.
