NOTICE OF VIOLATION l

Wisconsin Electric Power Dockets No. 50-266; 50-301 Company As a result of the inspection conducted on September 26 through December 11, 1986, and in accordance with 10 CFR Part 2, Appendix C - General Statement of Policy and Procedure for NRC Enforcement Actions (1985), the following violation was identified:

Technical Specification 15.4.4,Section I.A.2 states in part that, " Test Accuracy shall be verified by supplementary means such as measuring the quantity of air. . . by imposing a known leak rate to demonstrate the validity of measurements."Section I.B.4 states in part, "The supplementary test described in I.A.2 is acceptable, provided the difference between the supplcmental test data and the Type "A" test data is within 0.25 Lt. If results are not within 0.25 Lt, the reason shall be determined, corrective action taken, and a successful supplemental test performed."

10 CFR 50, Appendix J, Section III.A.3(b), states in part that, "The accuracy of any Type A test shall be verified by a supplemental test . . . conducted for sufficient duration to establish accurately the change in leakage between the Type A and supplemental test. .. If results are not within .25 La (or

.25 Lt) the reason shall be determined, correction action taken and a successful supplemental test performed."

Contrary to the above, the licensee failed to accurately verify the results of a Type A test by performing a supplemental test that was within 0.25 Lt. As a result, during their April 1984 Unit 1 integrated leak rate test the licensee did not determine the reason for this failure, take corrective action, or perform a satisfactory supplemental test following the Type A test.

This is a Severity Level IV violation (Supplement I).

Pursuant to the provisions of 10 CFR 2.201, you are required to submit to this office within thirty days of the date of this Notice a written statement or explanation in reply, including for each violation: (1) corrective action taken and the results achieved; (2) corrective action to be taken to avoid further violations; and (3) the date when full compliance will be achieved.

Consideration may be given to extending your response time for good cause shown.
