NOTICE OF VIOLATION Wisconsin Electric Power Docket No. 50-266 Company Docket No. 50-301 As a result of the inspection conducted on August 7 and 8, and October 16 and 17, 1986, and in accordance with 10 CFR Part 2, Appendix C - General Statement of Policy and Procedure for NRC Enforcement Actions (1985), the following violations were identified:

10 CFR 20.201(b) requires that surveys be conducted as may be necessary for the licensee to comply with 10 CFR 20.103 requirements and are reasonable to evaluate the radiation hazards.
Contrary to the above, adequate surveys were not performed to determine radiological conditions to support the July 19, 1986 changeout of the waste evaporator filter.
This is a Severity Level IV violation (Supplement IV).

Technical Specification 15.6.8 states that the plant will be operated in accordance with approved procedures.
Health Physics Procedure No. HP 1.11, Portal Monitor Use and Alarm Response, states that if the portal monitor continues to alarm after several recounts on the same individual, Security will initiate a report, instruct an individual to frisk, and notify the Duty Shift Superintendent.
Contrary to the above, on two occasions on July 20, 1986, after an individual caused the portal monitor to alarm the individual was not directed to frisk himself, report CHP-396 was not initiated, and the Duty Shift Superintendent was not notified; the employee was allowed to leave the gatehouse.
This is a Severity Level IV violation (Supplement IV).
Pursuant to the provisions of 10 CFR 2.201, you are required to submit to this office within thirty days of the date of this Notice a written statement or explanation in reply, including for each violation:
(1) corrective action taken and the results achieved; (2) corrective action to be taken to avoid further violations; and (3) the date when full compliance will be achieved.
Consideration may be given to extending your response time for good cause shown.
