1 NOTICE OF VIOLATION Wisconsin Electric Power Company Docket Nos. 50-266 50-301: 72-005 Point Beach Nuclear Plant Licenses No. DPR-24; DPR-27 During an NRC inspection cc,mpleted on December 6,1996, a violation of NRC requirements was identified, in accordance with NUREG-1600, " General Statement of Policy and Procedure for NRC Enforcement Actions", the violation is listed below:

License Condition 2.C and 2.D of Operating Licenses No. DPR-24 and DPR-27 authorizes the licensee, in part, to receive, possess and use byproduct source and special nuclear material pursuant to the Act and 10 CFR Parts 30,40, and 70 as sealed neutron sources for reactor startup, sealed sources for reactor instrumentation and radiation monitoring equipment calibration, and as fission detectors; and, without restriction to chemical or physical form, for sample analysis or instrument calibration or associated with radioactive apparatus or components. License Condition 2.E authorizes the licensee to possess byproduct and special nuclear materials as may be produced by the operation of the facility, but not to separate such materials retained within the fuel cladding.

Contrary to the aSove, on or about April 6,1995, the licensee failed to ensure that byproduct material was possessed and used in accordance with License Conditions 2.C, 2.D, or 2.E. Specifically, a contract laundry / decontamination technician deliberately taped a radioactive particle to the underside of a table in the radiological laundry room, a use of byproduct matorial not authorized by License Conditions 2.C, 2.D, or 2.E.

This is a Severity Level IV violation (Supplement IV).

The inspection showed that steps had been taken to correct the identified violation and to prevent recurrence. Consequently, no reply to this violation is required and we have no further questions regarding this matter.
