In the Matter of Application of Texas Utilities Generating Conpany, et al. for An Operating License for Comanche Peak Steam Electric Station Units #1 and #2 (CPSES)

Docket Nos. 50-445 and 50-446 Objections to Board's Findings and CASE's Answer to Applicants' 7/15/83 Sumary of the Record Regarding Weave and Downhill Welding On July 18, 1983, CASE was handed a copy of Applicants' 7/15/83 Sumary of the Record Regarding Weave and Downhill Welding. In the July 20,1983, conference call with all parties, the Board indicated that an opportunity would be afforded for response by parties to Applicants.' 7/15/83 pleading, including limited use of affidavits.

The Board also indicated that they did not plan to rely on Applicants' 7/15/83 pleading, and'in a telephone ~ conversation which CASE initiated to clarify the matter on July 25, 1983, Chainnan Bloch indicated that it was not necessary for CASE to file an answer to Applicants' 7/15/83 pleading (since the Board would consider neither Applicants' pleading nor CASE's answer to it in preparing their proposed findings in this regard).

However, since CASE had'already substantially completed its Answer to Applicants' 7/15/83 pleading at the time of the 7/25/83 telephone con-versation and since the format was already in the form of an Answer, we are filing it at this time. We assume that both Applicants and CASE will have the opportunity to supplement their responses (if necessary) as objections to the Board's proposed findings after they are received.
