Dear Mr. Denton:

It is understood that your office desires a status report on the condition of State and local emergency plans and preparedness measures for the McGuire nuclear power facility in North Carolina. Your need for, this information is for incorporation in your consideration of the is4ance of a license for low power testing. ,

The FEMA Regional Director, under whose responsi;ilities the State of North Carolina falls, has made such a review. He eports that North Carolina had progressed to the advance stages of planning under NUREG 75/111 during the latter months of 1979. The Regional Advisory Comittee reviewed the plan and found only 13 items not apparent. Upon issuance of HUREG 0654/ FEMA REP-1, the State proceeded to completely .

y revise the plan based on the new- criteria. l They have proceeded agressively and progressed well. Our Regional Director states that planning against the new criteria is at least 95% complete and covers all elements of the old criteria.

I refer to our exchange of letters on February'14,1980, pe'rtaining to the Sequoyah plant and subsequent action by the FEM /NRC Steering Comittee concerning criteria for emergency plans for plants during low power testing. It can be concluded that current North Carolina emergency preparedness, including the local governments surrounding the McGuire plant, is at least as effective as the standards established by NRC for concurrence in State plans prior to January 1,1980.

ir.a completed plan will be filed for FEMA review in early August and we will be in a position to provide you with a more detailed review by the end of August.
