McGuire Nuclear Station Docket Nos. 50-369, 370 In Inspection Report 96-11, the Nuclear Regulatory Commission opened Unresolved Item (URI) 96-11-03. This URI raised operability and design criteria conformance issues associated with certain hydraulic snubbers installed at McGuire Nuclear Station. It is Duke Energy's understanding that NRC regional staff generated a Technical Interface Agreement (TIA 97-02) memorandum requesting that Office of Nuclear Reactor Regulation (ONRR) staff evaluate this issue.

On June 16, 1997, ONRR issued a Request for Additional  ;

Information (RAI) requesting Duke Energy to demonstrate l l conformance with General Design Criterion (GDC) 2, " Design Bases  !

for Protection Against Natural Phenomena" and GDC-4,

" Environmental c:nd Dynamic Effects Design Bases." During a subsequent conference call between the NRC and Duke Energy, a specific request was made for the vendors technical basis for d satisfying ' post accident qualification requirements for the snubbers. By letter dated August 28, 1997, Duke Energy provided a response to the RAI and testing results provided by Grinnell Corporation. Duke concluded that the snubbers installed at McGuire are compliant with GDC-2, GDC-4 and are fully operable.

on October 30, 1997, ONRR issued another Request for Additional Information (RAIs) to Duke Energy. On February 4, 1998, Duke Energy and ONRR staff met in a public meeting at White Flint in Rockville,- Maryland to further discuss information related to the design, operability, and qualifications of the snubbers.

The meeting was instrumental in clarifying the basis for many of McGuire's assumptions. By letter dated April 3, 1998, McGuire provided additional information in response to the RAIs of June 16, '1997 and '.:tober 30, 1997 a'nd responded to staff questions raised during the public meeting.

l In Inspection Report 98-10, the NRC closed out URI (96-11-03) l without enforcement action. However, the ONRR staff response and I original TIA generated by the Region are not available on the l McGuire docket. Duke Energy requests that the NRC place the TIA j and ONRR response on dockets 50-369 and 50-370. This will i provide a complete licensing basis record of this issue on the l docket. l l
