Duke Energy Corporation McGuire Nuclear Station, Units 1 and 2 Docket Number 50-369 and 50-370 FOL NPF-9 & NPF-17 TAC NOS. M98964 and M98965 This letter reflects a telephone conference on March 18, 1999.

The NRR participants were Frank Rinaldi, Peter Tam, and Carrl Schulten. Mike Wilder of my staff represented McGuire Nuclear Station. i Duke Energy is making a license bases record change regarding license amendment submittals dated May 27, 1997, that were approved as Facility Operating License (FOL) NPF-9 and NPF-17, amendments 184 and 166, respectively. The change does not require amendment to the McGuire Nuclear Station FOL NPF-9 and l' NPF-17.

l Duke Energy submitted a proposed license amendment for McGuire 1 Nuclear Station FOL NPF-9 and NPF-17 by letter dated May 27, 1997, as supplemented by letters dated March 9, ?Iarch 20, April 20,. June 3, June 24, July 7, July 21, August 5 September 8 and September 15, 1998. The NRC issued amendment 134/166 on '

September 30, 1998. The amendments reflect full conversion from the. existing McGuire Technical Specifications to a set of Technical Specificetions based on NUREG 1431, " Standard Technical Specifications - Westinghouse Plants," Revision 1, dated April 1995.

In these submittals, Duke Energy inadvertently identified what ( O should have been a "more restrictive" as an " administrative" (,)\p'

amendments 184 and 166, respectively, included a more restrictive change that Duke Energy staff mis-identified as administrative in

Attached are the corrected mark ups for changing the record for the license amendment submittals dated May 27, 1997. I 1

The McGuire Unit 1 and 2 Technical Specifications were revised per FOL NPF-9 amendment 184 and NPF-17 amendment 166, respectively, to implement the NUREG 1431 improved format (ISTS).

The TS applicable prior to implementation of these mnendments  ;

(CTS) required operability of'the Loss of Power Diesel Generator l Start Instrumentation only in modes 1, 2, 3, and 4 with a l frequency of R (at least once per 18 months). The ISTS 3.3.5 j revised the applicability to also include "when associated DG is required to be OPERABLE by LCO 3.8.2." The associated DG is required to be available per ISTS 3.8.2 in modes 5, 6 and during movement of irradiated fuel assemblies.

The change in modes of applicability implemented with these j amendments were "more restrictive" in that the performance i requirement of the surveillance was revised from 18 months (not  !

applicable in modes 5 and 6), to every 18 months applicable in mode 5, 6 and during movement of irradiated fuel. The additional modes of applicability effectively reduced the schedule interval for performance of the surveillance. The CTS requirement allowed scheduling the surveillance with the 18 month interval applicable only during the mode 1 through 4 operation, which would allow scheduling the surveillance prior to entry to mode 4 during Unit outages. The ISTS is thus, "more restrictive" in that the mode of applicability continues through the outage resulting in an ongoing 18 month requirement from the last performance of the surveillance. The approximate duration between exiting mode 4 during-shutdown to reentering mode 4 during startup for the current Unit-2 outage is approximately 28 days.

With the reclassification of SR 3.3.5.2 as, "more restrictive" from " administrative", the license condition issued as part of the license amendment 184/166 applies. Specifically, "For SR's that existed prior to Amendment No. 184 [ Amendment 166], whose intervals of performance are being reduced, the first reduced surveillance interval begins upon completion of the first surveillance performed after implementation of Amendment No. 181 (Amendment No. 166]." l 1
