Limerick Generating Station, Unit 1 Clarification of Spent Fuel Pool Capacity Gentlemen:

On November 29,1994, the NRC issued Amendment No. 82 to Facility Operating License No.

NPF-39 and Amendment No. 43 to Facility Operating License No. NPF-85 for Limerick Generating Station (LGS) Units 1 and 2. These amendments permitted a modification to install new high density spent fuel storage racks in each of the spent fuel pools, that would increase the storage capacity in each spent fuel pool to 4117 fuel assemblies. Also, on June 30,1994, the NRC issued Amendment No. 72, to Facility Operating License No. NPF-39, which authorized an increase from 2040 to 2500 fuel assemblies for the LGS Unit 1 spent fuel pool. Amendment No.

72 was considered an interim amendment that allowed the transfer of all of the fuel from the Unit 2 spent fuel poolinto the Unit 1 spent fuel pool, and permitted the reracking of Unit 2 without any fuel in the spent fuel pool.

By letter dated January 10,1995 PECO Energy informed the NRC that the reracking of the LGS Unit 2 spent fuel pool had been completed on December 2,1994, and that the reracking of the LGS Unit 1 spent fuel pool was in the planning stage and a schedule for implementation had not yet been developed.

Recent discussions with the NRC staff indicated that Amendment No. 82 to the LGS Unit 1  ;

Facility Operating License was only intended for a reracked spent fuel pool. As such, Technical Specifications Page 5-8, which was revised by Amendment No. 82 to reflect rerack conditions, should not have been placed in the controlled Technical Specifications until the reracking of LGS Unit 1 was complete.

To reflect the current Unit 1 plant conditions (i.e., spent fuel pool reracking not completed),

PECO Energy willimplement administrative controls to ensure that the LGS Unit 1 spent fuel pool is limited to a capacity and a center-to-center spacing that was previously approved by NRC in Amendment No. 72. The administrative controls will consist of the following note:

The spent fuel pool capacity is limited to 2500 fuel assemblies, and a nominal 6.625 inches center-to-center spacing between fuel assemblies shall apply, until the completion of the high density reracking of the spent fuel pool.

spent fuel pool configuration) and to appropriate plant procedures. Upon completion of the Unit 1 teracking, this note will be removed.
