NOTICE OF VIOLATION Tennessee Valley Authority Docket Nos. 50-327 and 50-328 Sequoyah Nuclear Plant License Nos. DPR-77 and DPR-79 During an NRC inspection conducted on March IS through April 25, 1998, a violation of NRC requirements was identified. In accordance with the " General Statement of Policy and Procedures for NRC Enforcement Actions." NUREG-1600, the violation is listed below-Technical Specification (T.S.) 3.8.1.1.b requires "as a minimum, the following A.C. electrical power sources shall be operable: Four separate and independent diesel generator sets each with a separate fuel storage system containing a minimum volume of 62.000 gallons of fuel and a separate fuel oil transfer pump. I The Updated Final Safety Analysis Report. Section 8.3.1.1. Description -

Diesel Fuel Oil System, states " Transfer of fuel between the seven day supply tanks and the engine day tanks is accomplished automatically by a pair of pumps controlled by float operated switches which sense fuel level in the engine day tanks."

The T.S. definition for Operability. Section 1.19. states "A system.

subsystem, train, or component or. device shall be Operable or have Operability when it is capable of performing its specified functions and when all attendant. . auxiliary equipment that are required for the system, subsystem, train, component or device to perform its functions are also capable of performing their related support function."

T.S 3.8.1.1 action "b" requires that with a diesel generator inoperable, demonstrate the operability of the remaining A.C. sources by performing Surveillance Requirement 4.8.1.1.1.a within one hour and at least once per 8 hours9.259259e-5 days <br />0.00222 hours <br />1.322751e-5 weeks <br />3.044e-6 months <br /> thereafter.

1 Contrary to the above on March 24. 1998, the licensee failed to perform Surveillance Requirement 4.8,1.1.1.a. within one hour and at least once per 8 hours9.259259e-5 days <br />0.00222 hours <br />1.322751e-5 weeks <br />3.044e-6 months <br /> thereafter, when the IA-A diesel generator automatic start circuitry of the fuel oil transfer system was disabled for a period of approximately 13 hours1.50463e-4 days <br />0.00361 hours <br />2.149471e-5 weeks <br />4.9465e-6 months <br /> and 20 minutes, thus rendering the transfer pumps inoperable. The transfer pumps could no longer perform their intended L function of automatically filling the emergency diesel day tanks, which resulted in an inoperable 1A-A diesel generator This is a Severity Level IV Violation (Supplement I).

Pursuant to the provisions of 10 CFR 2.201. Tennessee Valley Authority is hereby required to submit a written statement or explanation to the U.S. j Enclosure 1

20555 with a copy to the Regional Administrator, Region II, and a copy to the NRC Resident Inspector at the Sequoyah facility, within 30 days of the date of the letter transmitting this Notice of Violation (Notice). This reply should be clearly marked as a " Reply to a Notice of Violation", and should include for each violation: (1) the reason for the violation, or, if contested, the basis for disputing the violation (2) the corrective steps that have been taken and the results achieved (3) the corrective steps that will be taken to avoid further violations, and (4) the date when full compliance will be achieved. Your response may reference or include previously docketed correspondence if the correspondence adequately addresses the required response. If an adequate reply is not received within the time specified in this Notice, an order or Demand for Information may be issued as to why the license should be modified, suspended, or revoked, or why such other action as may be proper should not be taken. Where good cause 1s shown, consideration will be given to extending the response time.

If you contest this enforcement action, you should also provide a copy of your response to the Director Office of Enforcement, United States Nuclear Regulatory Commission. Washington. DC 20555-0001.
