EN 97-1092 OFFICE OF ENFORCEMENT NOTIFICATION OF SIGNIFICANT ENFORCEMENT ACTION Licensee: Tennessee Valley Authority (EA 97-409)

Sequoyah Units 1 and 2 Docket Nos. 50-327 and 50-328

WITHDRAWAL OF PROPOSED CIVIL PENALTY - $55,000 By EN 97-109 dated December 3,1997, the Commission was notified of the intent to issue a Notice of Violation and Proposed imposition of Civil Penalty in the amount of $55,000 to the Tennessee Valley Authority. This action was issued on December 8,1997. The action was based on one Severity Level lli problem consisting of three violations related to a failure to maintain a direct current vital battery channel energized and operabie. Because l this was not the first escalated enforcement action within 2 years, the staff considered whether credit was warranted for identification and corrective action in accordance with the civil penalty assessment process described in Section Vll.B.2 of Enforcement Policy. Credit was determined to be warranted for corrective action. Credit was not considered warranted for identification because prior opportunities to identify the violations existed.

The licensee responded to the Notice admitting the violation but requesting that the NRC reconsider its determination that credit was not warranted for identification. After careful consideration of the licensee's response, the Staff has concluded that despite prior opportunities to identify the violations, credit for identification is appropriate to recognize the diligence of the TVA training instructor who discovered the vital battery problem and took prompt action to ensure system operability.

It should be noted that the licensee has not been specifically informed of the withdrawal.
