NOTICE OF VIOLATION I

Tennessee Valley Authority Docket Nos. 50-327 and 50-328 l Sequoyah Nuclear Plant License Nos. DPR-77 and DPR-79 ,

1 During an NRC inspection conducted on November 15-19, 1993, violations of NRC requirements were identified. In accordance with the " General Statement of- i Policy and Procedure for_NRC Enforcement Actions," 10 CFR Part 2, Appendix C (1993), the violations are listed below:

a. 10 CFR 50.54(i-1) states "the licensee shall have in effect an t operator requalification program which must, as a minimum, meet the requirements of 10 CFR 55.59(c) of this chapter". t 10 CFR 55.59(c)(4) states "The requalification program must include- l (i) Comprehensive requalification written examinations and annual operating tests which determine areas in which retraining is  !

needed...".  !

l 10 CFR 50, Appendix B, Criterion V, states " Activities affecting ,

quality shall be prescribed by documented instructions, procedures,  ;

or drawings of a type appropriate to the circumstances and shall be accomplished in accordance with these instructions, procedures,'or j -

drawings. Instructions procedures, or drawings shall include  !

appropriate quantitative or qualitative acceptance _ criteria for  !

determining that important activities have been satisfactorily t' accomplished".

Contrary to the above, procedures delineating the process for administering the comprehensive requalification examinations did not ,

contain appropriate guidance for conducting or documenting annual  !

operating tests.

b. 10 CFR 50.54(1-1) states "the licensee shall have in effect an  !

operator requalification program which must, as a minimum, meet the i requirements of 10 CFR 55.59(c) of this chapter".  !

10 CFR 55.59(c)(3) states "The requalification program must include on-the-job training so that (i) Each licensed operator manipulates ,

the plant controls and each senior licensed operator either manipulates or directs the activities of individuals during plant i control manipulations during the term of the licensed operator's or l senior operator's license". l 10 CFR 55.59(c)(5)(i) states "The facility shall maintain records documenting the participation of each licensed operator and senior i operator in the requalification program" and that the records must l 2

contain "the results of evaluations and documentation of operating l tests...".  ;

Contrary to the above, records maintained to document licensed operator completion of operating tests and performance of on-the-job training did not contain sufficient information to furnish evidence that the activities were conducted in accordance with regulations.

These violations have been evaluated in the aggregate as a Severity Level IV problem (Supplement VII.D)  !,

Pursuant to the provisions of 10 CFR 2.201, the Tennessee Valley Authority is hereby required to submit a written statement or explanation to the U. S. ,

Nuclear Regulatory Commission, ATTN: Document Control Desk, Washington, D.C.

20555 with a copy to the Regional Administrator, Region II, and a copy to the .

NRC Resident Inspector at the facility that is the subject of this Notice, l within 30 days of the date of the letter transmitting this Notice of Violation ,

(Notice). This reply should be clearly marked as a " Reply to a Notice of Violation" and should include for each violation; (1) the reason for the  !

violation, or if contested, the basis for disputing the violation, (2) the  !

corrective steps that have been taken and the results achieved, (3) the i corrective steps that will be taken to avoid further violations, and (4) the  !

date when full compliance will be achieved. If an adequate reply is not ,

received within the time specified in this Notice, an order or demand for information may be issued as to why the license should not be modified, suspended, or revoked, or why such other action as may be proper should not be taken. Where good cause is shown, consideration will be given to extending ,

the response time.  !
