December 3,1997 EN 97109 OFFICE OF ENFORCEMENT NOTIFICATION OF SIGNIFICANT ENFORCEMENT ACTION Licensee: Tennessee Valley Authority (EA 97-409)

Sequoyah Units 1 and 2 Docket Nos. 50-327 and 50 328 Su~o iect: PROPOSED IMPOSITION OF CIVIL PENALTY - $55,000 This is to inform the Commission that a Notice of Violation and Proposed Imposition of Civil Penalty in the amount of $55,000 will be issued on or about December 8,1997, to the Tennessee Valley Authority. The action is based on one Severity Level 111 problem consisting of three violations related to a failure to maintain a direct current vital battery channel energized and operable. These violations are of significant regulatory concem because of the importance of the batt6ry in loss of offsite power events and because of the poor performance of the operating staff associated with this matter. Because this was not the first escalated enforcement action within 2 years, the staff considered whether credit was warranted for identification and corrective action in accordance with the civil penalty assessment process described in Section Vll.B.2 of Enforcement Policy. Credit was determined to be warranted for corrective action. Credit was not warranted for identification because prior opportunities to identify the violations existed, it should be noted that the licensee has not been specifically informed of the enforcement action. The schedule of issuance and notification is:

Mailing of Notice December 8,1997 Telephone Notification of Licensee December 8,1997 The State of Tennessee will be notified.

The licensee has thirty days from the date of the Notice in which to respond. Fofowing NRC evaluation of the response, the civil penalty may be remitted, mitigated, or imposed by Order.
