h ENCLOSURE 1 NOTICE OF VIOLATION Tennessee Valley Authority Docket Nos. 50-327, 50-328 Sequoyah Units 1 and 2 License Nos. DPR-77, DPR-79 f

During the Nuclear Regulatory Commission (NRC) inspection conducted from November 7 through December 4,1993, a violation of NRC requirements was identified. In accordance with the " General Statement of Policy and Procedure for NRC Enforcement Actions," 10 CFR Part 2, Appendix C, the violation is listed below:

Technical Specification Section 6.8.1 requires, in part, that procedures shall be established, implemented, and maintained covering the activities recommended in Appendix A of Regulatory Guide 1.33, Revision 2, February 1978. Appendix A of Regulatory Guide 1.33 includes procedures to perform surveillance requirements.

Implicit in these requirements is that the procedures be adequate.

10 CFR 50, Appendix J, requires, in part, that a general inspection of the accessible interior and exterior surfaces of the containment structure be performed.

Technical Specification 4.6.1.6

requires, in part, that a visual inspection of the exposed, accessible interior and exterior surfaces of the containment vessel be performed.

The procedures for Units 1 and 2 respectively, SI-254 and SI-254.2, CONTAINMENT VESSEL AND SHIELD BUILDING INTEGRITY VERIFICATION, implement the requirements of 10 CFR 50, Appendix J and Technical Specification f

Surveillance Requirement 4.6.1.6.

Contrary to the above, prior to July 1993, SI-254 and SI-254.2 were inadequate, in that, they did not contain provisions to periodically inspect the area of the containment liner which was covered by stainless steel flashing in the lower containment raceway.

This resulted in the failure of the licensee to identify the existence of water accumulation, l

some containment liner degradation, and design inconsistencies.

l This is a severity level IV violation (Supplement 1).

Pursuant to the provisions of 10 CFR 2.201, Tennessee Valley Authority is hereby I

required to submit a written statement or explanation to the U.S. Nuclear Regulatory Commission, ATTH: Document Control Desk, Washington, D.C. 20555 with i

a copy to the Regional Administrator, Region II, and a copy to the NRC Resident l

Inspector, within 30 days of the date of the letter transmitting this Notice of Violation (Notice). This reply should be clearly marked " Reply to a Notice of Violation" and should include for each violation: (1) the reason for the violation, or, if contested, the basis for disputing the violation, (2) the 9401040150 931223 l

If an adequate reply is not received within the time specified in this Notice, an order or demand for information may be issued as to why the license should not be modified, suspended, or revoked, or why such other action as may be proper should not be taken. Where good cause is shown, consideration will be given to extending the response time.
