NRC INSPECTION REPORT 70-7001/97009(DNMS)

AND NOTICE OF VIOLATION Dear Mr. Miller.

On September 12,1997, the NRC completed a routine quality assurance program inspection at your Paducah Gaseous Diffusion Plant. The enclosed report presents the results of the inspection.

Based on the results of the inspection, the NRC has determined that a violation of NRC requirements occurred. The violation is cited in the enclosed Notice of Violation (Notice) and the circumstances surrounding the violation are desenbed in detail in the enclosed report. The violation is of concem because it indicates a lack of knowledge of a q"ality requirement by responsible staff and a failure to include a requirement of your Quality Assurance Program into implementing procedures.

You are required to respond to this letter and should follow the instructions specified in the enclosed Notice when preparing your response to the violation. The NRC will use your response, in part, to determine whether further enforcement action is necessary to ensure compliance with regulatory requirements.

in addition, the NRC requests a response to Unresolved item (URI) 70-7001/97009-01, within thirty u./s of the date of this letter. Your response should provide the United States Enrichment Corporation's position as to which supplementary requirements of ASME NQA-1-1989 it has iraplemented, along with any supporting documentation, and which supplementary requirements are currently not being implemented at either of the Gaseous Diffusion Plants. The response should not include those supplements for which specific exceptions or attematives have been approved in the Quality Assurance Program (for example, Sections 2.2.4 and 2.17.3,8 of the Qudly Assurance Program specify an acceptable attemative and an exception with a technical justification, respectively). The response should include the rationale for not implementing any supplementary requirements for which an exception or altemative has not been approved.

In accordance with 10 CFR 2.790 of the NRC's " Rules of Practice" a copy of this letter, its enclosures, and your response will be placed in the NRC Public Document Room (PDR).
