Dear Mr. Wiesemann:

Subject:

Request for Withholding Infomation from Public Disclosure Beaver Valley Power Station - Unit No. 2 (

Reference:

CAW-85-026)

By letter dated March 29, 1985, Duquesne Light Company forwarded the bounding seismic response spectrum curve for Beaver Valley Unit 2 and your application and affidavit dated March 20, 1985, and requested that the figure be withheld from public disclosure pursuant to 10 CFR 2.790.

You stated that the submitted information should be considered exempt from mandatory public disclosure for the following reasons: The information is of a type customarily held in confidence by Westinghouse, is not available in public sources, its disclosure would likely cause substantial harm to the competitive position of Westinghouse, and its development is the result of substantial effort and considerable sum of money.

We have reviewed your application and the material based on the requirements and criteria of 10 CFR 2.790 and, on the basis of your statements, have deter-mined that the submitted information sought to be withheld contains trade secrets or proprietary comercial information.

Therefore, the version of the submitted information marked as proprietary will i

be withheld from public disclosure pursuant to 10 CFR 2.790(b)(5) and Section 103(b) of the Atomic Energy Act of 1954, as amended.

Withholding from public inspection shall not affect the right, if any, of persons properly and directly concerned to inspect the document. If the need arises, we may send copies of this information to our consultants working in this area. We will, of course, ensure that the consultants have signed the appropriate agreements for handling proprietary information.
