ORDER APPROVING THE TRANSFER OF LICENSES FOR BEAVER VALLEY POWER STATION, UNITS 1 AND 2, FROM DUQUESNE LIGHT COMPANY TO PENNSYLVANIA POWER COMPANY AND APPROVING CONFORMING AMENDMENTS (TAC NOS. MA5370 AND MA5371)

Dear Mr. Cross:

The enclosed Order is in response to the application from the Duquesne Light Company (DLC) and FirstEnergy Nuclear Operating Company, acting for itself and Pennsylvania Power Company, dated May 5,1999 (L-99-068), as supplemented June 22, and July 30,1999. The application requested approval of the transfer of Operating Licenses DPR *" md NPF-73 to the extent required in connection with the proposed transfer of DLC's ow.. , :nterests in Beaver Valley Power Station, Units 1 and 2 (BVPS-1 and 2), to Pennsylvania Power Company; approval of the transfer of DLC's operating authority under the licenses to FirstEnergy Nuclear Operating Company; and approval of conforming amendments to reflect the transfer of ownership and operating authority pursuant to Sections 50.80 and 50.90 of Title 10 of the Code of Federal Reaulations. The enclosed Order gives consent to the proposed transfers, subject to the conditions described therein. The Order also approves conforming license amendments, which will be issued and made effective when the transfers are completed.

The Nuclear Regulatory Commission (NRC) has recently been contacted by various interested parties, including U.S. Congressmen, Pennsylvania State and local politicians, and the International Brotherhood of Electrical Workers, all of whom expressed concerns over the potential impacts that proposed staffing reductions at BVPS-1 and 2 might have on safe operation of the plants. in renard to safe operation of the facility, it must be noted that all of the existing NRC requirements regarding operation and maintenance of equipment importarit to safety and safe operation of the facility will continue to apply directly to BVPS-1 and 2 after the transfer of ownership and operating licenses. Although business decisions regarding plant staffing, beyond the shift operating crew, personnel qualification, and organizational structure requirements which are specified in the TSs and UFSARs, are not specifically subject to the

NRC's regulatory regime, sufficient resources must be provided to ensure the NRC's requirements are met. The NRC will continue, through its inspection programs, to ensure that BVPS-1 and 2 continue to be operated and maintained safely in accordance with the existing license requirements.
