Dear Mr. Cross:

' By letter dated January 31,1996, Duquesne Light Company (DLC) submitted a summary report containing the results of the USl A-46 program implementation at BVPS-1. By letters dated May 18,1997, and June 2,1998, DLC provided supplemental information and

) clarification in response to the NRC staff's requests for additional information (RAI), dated i January 10,1997, and March 4,1998, respectively.

I The NRC staff has completed its evaluation of DLC's USI A-46 implementation program and has concluded that DLC's implementation program has, in general, met the purpose and intent of the criteria in Generic implementation Procedure 2 and the staff's Supplemental Safety Evaluation Report No. 2 for the resolution of USI A-46. The NRC staff has determined that 4 DLC's corrective actions and completed physical modifications for resolution of outliers will l l result in safety enhancements that are beyond the original licensing basis in certain respects. I i Accordingly, these actions and modifications provide sufficient basis to close the USI A-46 l

review for BVPS 1. The NRC staff also concludes that DLC's implementation program to f

resolve USl A-46 at BVPS 1 has adequately addressed the purpose of the May 22,1992, 10 CFR 50.54(f) letter. Licensee activities related to the USl A-48 implementation are subject l to NRC inspection.

By letter dated January 31,1996, Duquesne Ught Company (DLC) submitted a summary report containing the results of the USl A-46 program implementation at BVPS-1. By letters dated May 16,1997, and June 2,1998, DLC provided supplemental information and clarification in response to the NRC staff's requests for additional information (RAl), dated January 10,1997, and March 4,1998, respectively.

The NRC staff has completed its evaluation of DLC's USl A 46 implementation program and has concluded that DLC's implementation program has, in general, met the purpose and intent of the criteria in Generic implementation Procedure 2 and the staff's Supplemental Safety Evaluation Report No. 2 for the resolution of USl A-46. The NRC staff has determined that DLC's corrective actions and completed physical modifications for resolution of outliers will result in safety enhancements that are beyond the originallicensing basis in certain respects.

Accordingly, these actions and modifications provide sufficient basis to close the USI A-46 review for BVPS-1. The NRC staff also concludes that DLC's implementation program to resolve USl A 46 at BVPS 1 has adequately addressed the purpose of the May 22,1992, 10 CFR 50.54(f) letter. Ucensee activities related to the USl A-46 implementation are subject -

to NRC inspection.
