i; ENCLOSURE 1 NOTICE OF VIOLATION Duke Power Company Docket No. 50-369 McGuire Unit 1 License No. NPF-9 During the Nuclear Regulatory Commission (NRC) inspection conducted on .

February 28, 1989 through March 29, 1989, a violation of NRC requirenients was  !

identified. In accordance with the " General Statement of Policy and Procedure for NRC Enforcement Actions," 10 CFR Part 2, Appendix C (1988), the violation is identified below:

Technical Specification 6.8.1 requires that written procedures be established, implemented , and maintained covering the activities recommended in Appendix A of Regulatory Guide 1.33, Revision 2, February 1978.

l l l Regulatory Guide 1.33, Revision 2, February 1978, Appendix A, requires that procedures be written and implemented for maintenance on equipment that can affect the performance of safety-related equipment.

Contrary to the above, McGuire procedure MP/0/A/7600/06, Kerotest Y-Type Globe Valve Corrective Maintenance, was not properly implemented in that

" hold points" were skipped without performing the required actions, obtaining the requireo signatures, or changing the procedure prior to continuing with work on IVG-40, DG Starting Air Tank 182 Drain Valve.

This is a Severity Level IV (Supplement I) violation and applies to Unit 1 phly.

Pursuant to the provisions of 10 CFR 2.201, Duke Power Company is hereby required to submit a written statement or explanation to the U.S. Nuclear Regulatory Commission, ATTN: Document Control Desk, Washington, DC 20555 with a copy to the Regional Administrator, Region II, and a copy to the NRC Resident

, Inspector, McGuire Nuclear Station within 30 days of the date of the letter l

transmitting this Notice. Thir reply should be clearly marked as a " Reply to a Notice of Violation" and should include for each violation: (1) admission or denial of the violation, (2) the reason fcr the violation if admitted, (3) the corrective steps which have been taken and the results achieved,- (4)' the corrective steps which will be taken to avoid further violations, and (5) the date when full compliance will be achieved. consideration will be given to extending the response time. If an adequate reply is not received within the time specified in this Notice, an order may be  !
