NOTICE OF VIOLATION Duke Power Company Docket Nos. 50-369 and 50-370 McGuire Nuclear Plant License Nos. NPF-9 and NPF-17 During an NRC inspection conducted on May 18 through June 28, 1997 a violation of NRC requirements was identified. In accordance with NUREG 1600

" General Statement of Policy and Procedure for NRC Enforcement Actions." the violation is listed below:

Technical Specification 6.8.1 requires that written procedures shall be established, implemented. "nd maintained covering the applicable procedures recommended in Appendix A of Regulatory Guide 1.33. Revision 2. February 1978.

Inherent in this requirement is that the procedure be adequate to perform plant activities.

Contrary to the above on May 27. 1997 Procedure IP/0/A/3250/12B Train B l Diesel Sequencer Timer Calibration. was inadequate to provide sufficient guidance to properly test the Emergency Diesel Generator sequencer logic l circuitry. As a result, an inadvertent safety injection signal and subsequent j blackout signal were generated during performance in Unit 2 which resulted in the actuation of several Engineered Safety Features components.

Region II. and a copy to the NRC Resident Inspector, at the McGuire facility, within 30 days of the date of the letter transmitting this Notice of Violation (Notice). This reply should be clearly marked as a " Reply to a Notice of Violation" and should include for each violation: (1) the reason for the violation or, if contested, the basis for disputing the violation. (2) the corrective steps that have been taken and the results achieved. (3) the corrective steps that will be taken to avoid further violations. and (4) the date when full compliance will be achieved. l Your response may reference or include previous docketed correspondence, if '

the correspondence adequately addresses the required response. If an adequate reply is not received within the time specified in this Notice, an order or demand for information may be issued as to why the license should not be modified, suspended, or revoked, or why such other action as may be 3 roper should not be taken. Where good cause is shown, consideration will 3e given to extending the response time.
