ENCLOSURE 1 NOTICE OF VIOLATION Duke Power Company Docket Nos. 50-369, 50-370 McGuire Units 1 and 2 License Nos. NPF-9, NPF-17 During the Nuclear Regulatory Commission (NRC) inspection conducted on~ May 22,.

1990 through June' 25,1990, a violation of NRC requirements was identified.

In accordance with the " General Statement of Policy and Procedure for NRC Enforcement Actions," 10 CFR Part 2, Appendix C (1990), the violation is identified below:

A. Technical Specification (TS) 3.7.6 requires two' independent Control Room Ventilation-(VC) Systems to be operable at all times. If both trains of VC are inoperable the licensee is required to enter TS_3.0.3 which requires that within 1 hour1.157407e-5 days <br />2.777778e-4 hours <br />1.653439e-6 weeks <br />3.805e-7 months <br /> action shall be initiated to place the unit in a MODE in which the specification does not apply by placing it, as applicable -in:

1. At least HOT STANDBY within the next 6 hours6.944444e-5 days <br />0.00167 hours <br />9.920635e-6 weeks <br />2.283e-6 months <br />,
2. At least HOT SHUTDOWN within the following 6 hours6.944444e-5 days <br />0.00167 hours <br />9.920635e-6 weeks <br />2.283e-6 months <br />, and 3.. At least COLD SHUTDOWN within the subsequent 24 hours2.777778e-4 days <br />0.00667 hours <br />3.968254e-5 weeks <br />9.132e-6 months <br />..

TS 4.7.6.e.3 requires that'VC be able to maintain a' positive pressure in the Control Room of greater than or equal to 1/8-inch water gauge relative to outside atmosphere.

Contrary to the above, the licensee operated both Units at Power Operation with two of four VC intakes closed from May 25, 1990 until June 3, 1990 rendering both VC trains inoperable. i.e. unable to meet the TS required pressurization criteria.

This is a Severity Level IV Violation (Supplement 1)

B. 10 CFR 50.72 (b) (iii) (d) requires that the licensee report to NRC within-4-hours any. event or condition that alone could have prevented the ful-fillment of the safety function of systems that are needed to mitigate the consequences of an accident.

Contrary to the above, the licensee discovered an inoparability of both trains of the Control Room Ventilation System at 10:? p.m. on June 3, 1990 but did not report the event to NRC until 5:30 p.w. on June 4,1990.

This is a Severity Level IV Violation (Supplement I).

written procedures.

Maintenance Management Procedure No. 1.5, Work Request Processing, states-in part. that Section; IX of the work request is used to document. the ,

completion, acceptance, and approval- of the maintenance activity and  ;

associated documentation.  !

- Contrary to: the 'above, on June 20, 1990 Section IX of the work request  !

(WR) No.142319, Repair Mechanical Pump Seal Leak on 1B1 KC pump, was  !

signed off by, an acting supervisor prior to completion of one of two l L procedures. Mechanical ' workers failed to implement procedure No. l MP/0/A/7700/45, The Controlling Procedure for System Leakage Testing of 1 ASME Mechanical Connections and/or.ASME Section XI Suitability Evaluation, I after -the completion of corrective maintenance as required by the WR. i

This procedure required QC' hold point inspection to detemine system
leakage as part of overall functional verification. q

Pursuant to L the . provisions of' 10 'CFR 2.201, Duke Power Company is hereby required to' submit a written statement or explanation to the U.S. Nuclear 1 Regulatory Commission, ATTN: Document Control Desk, Washington, DC 20555 with a copy to the Regional Administrator, Region.II, and a copy to the NRC Resident

- Inspect.or, .McGuire Nuclear Station within 30 days of the date of the letter transmitting this Notice. This reply should be clearly marked as a " Reply to a i l' Notice of Violation" and should include for each violation: (1) admission or  !

denial of the violation, (2) the reason for the violation if ' admitted, (3) the corrective steps which have been taken and the results achieved,(4) the o ..

corrective steps which will be taken to avoid further violations, and (5) the 4 date when full compliance will be achieved. Where good cause is shown, consideration will' be given to extending the . response time. If an adequate E
