1 ENCLOSURE 1 NOTICE OF VIOLATION Duke Power Company Docket Nos. 50-369, 50-370 l
McGuire Units 1 and 2 License Nos. NPF-9, NPF-17 During an NRC inspection conducted on June 21-25, and July 29, 1993, a violation of NRC requirements was identified.
In accordance with the " General Statement of Policy and Procedure for NRC Enforcement Actions," the violation is listed below:
Technical Specification 6.8.1 states that written procedures shall be established, implemented, and maintained.
Implementing procedure RP/0/A/5700/00, Classification of Emergency, Section 2.0, Immediate Actions, Step 2.1 instructs the user to compare actual plant conditions to the Emergency Action Level (s) listed in Enclosure 4.1 then declare i
the appropriate Emergency Class as indicated.
Contrary to the above, a loss of offsite power event on Unit 1 occurred at 13:55 hours on February 11, 1991, for which the licensee failed to immediately declare a Notification of Unusual Event.
Instead, the licensee classified a subsequent event as a Notification of Unusual Event based on valid Safety Injection signal, at 14:20 on February 11, j
1991.

Pursuant to the prcvisions of 10 CFR 2.201, Duke Power Company is hereby required to submit a written statement or explanation to the U.S. Nuclear Regulatory Commission, ATTN: Document Control Desk, Washington, D.C. 20555 with a copy to the Regional Administrator, Region II, and a copy of the NRC Resident Inspector at the facility that is the subject of this Notice, within 30 days of the date of the letter transmitting this Notice of Violation (Notice). This reply should be clearly marked as a " Reply to a Notice of i
Violation" and should include. for each violation:
(1) the reason for the violation, or, if contested, the basis for disputing the violation, (2) the corrective steps that have been taken and the results achieved, (3) the l
corrective steps that will be taken to avoid further violations, and (4) the date when full compliance will be achieved.
If an adequate reply is not received within the time specified in this Notice, an order or Demand for Information may be issued as to why the license should not be modified, suspended, or revoked, or why such other action as may be proper should not be taken. Where good cause is shown, consideration will be given to extending the response time.
