NOTICE OF VIOLATION Duke Energy Corporation Docket Nos. 50 369. 50-370 McGuire Units 1 and 2 License Nos. NPF-9. NPF-17 During an NRC inspection conducted on January 5 8, 1998 violations of NRC requirements were identified. In accordance with the ' General Statement of Policy and Procedure for NRC Enforcement Actions." (NUREG 1600) the violations are listed below:

A. Technical Specification 6.8 requires, in part, that written procedures shall be established, implemented and maintained for applicable procedures in Appendix A to Regulatory Guide 1.33. Revision 2, 1978.

Appendix A specifies procedures for Security and Visitor Control.

McGuire Procedure Nuclear Station Directive 218 of Nuclear Policy Manual-Volume 2. requires management, in the case of involuntary and voluntary termination, to be responsible for verbaliy notifying, site security and/or site staffing contacts to delete the individuals' security badge. For involuntary terminations, security is to be notified prior to the termination / discharge or simultaneously with the termination / discharge. Security Procedure EXAO-02. Security Badge Prc im. Revision 62. paragraph Ill.B.8.c. provides that if termination is t ' nble. security shall be contacted.

Contrary to the above, the licensee failed to follow procedures for security badge and access control. An employee quit on or about October 15. 1997. The employee's supervisor did not notify security to terminate the employee's badge. On October 26. 1997, it was identified that the employee quit and a group supervisor notified security to put the terminated individual's badge on administrative hold. The individual's badge was put on administrative hold by security at 8:13 a.m. on October 26. On October 27, 1997. security was notified to terminate the former employee's badae. The badge was cancelled at 4:55 p.m. on October 27. 1997. The employee did not return to the site between October 16 and October 27, 1997.

This is a Severity Level IV violation (Supplement III).

Notice of Violation 2 B. The McGuire Facility Operating License NPF-17. Part 2.E. states, in part, that the licensee shall fully implement and maintain in effect all provisions of the Commission approved physical security, guard training and qualification, and safeguards contingency plans.

Duke Power Company Nuclear Security and Contingency Plan. Revision 6.

dated May 13. 1997. Chapter 6. " Access". " ragraph 6.3. provides that protected area badges shall remain within the protected area.

Security Procedure EXA0-2. Security Badge Program. Rev 62, paragraph Ill.B.5.c provides that prior to exiting the protected area, all badges shall bc returned to the exit turnstile at the primary access portal.

Contrary to the above, the licensee failed to follow Security Procedure EXAO-2 on October 22, 1997, at approximately 6:30 p.m.. in that the licensee failed to control a protected area access badge when an employee exited the protected area with their security badge. On October 23. the individual reported to security that their badge was inadvertently taken home.

This is a Severity Level IV violation (Supplement III).

The NRC has concluded that information regarding the reason for the violations (Violations 04 and 05 of Section S1.2), the corrective actions taken and planned to correct the violations and prevent recurrence and the date when full compliance was achieved is already adequately addressed on the docket in your reply to a notice of violation letter, dated October 23. 1997. However, you are required to submit a written statement or explanatinn pursuant to 10 CFR 2.201 if the description therein does not accurately reflect your corrective actions or your position. In that case or if you choose to respond, clearly marked as a " Reply to a Notice of Violation:" and send it to the U.S. Nuclear Regulatory Commission. ATTN: Document Control Desk.

Washington. D.C. 20555 with a copy to the Regional Administrator. Region II, and a copy to the NRC Residant Inspector at the McGuire Nuclear Station, within 30 days of the date of the letter transmitting this Notice of Violation (Notice).
