.LNCLOSURE 1 NOTICE OF VIOLATION Duke Power Company Docket Nos.60-369 and 50-370 McGuire Units l'and 2 License Nos. NPF-9 and NPF-17 During the Nuclear Regulatory Commission (NRC) inspection conducted on March 30,1989 through April 21, 1989, a violation of NRC requirements was identified.

In accordance with the " General Statement of Policy and Procedure for NRC Enforcement Actions," 10 CFR Part 2, Appendix C (1988), the violation is identified below:

10 CFR 50, Apoendix B, Criterion V as implemented by Duke Topical Report, Duke-1, Chapter 17.2.5 require:, that activities affecting quality be prescribed by documented instructions, procedures, or drawings, of a type appropriate to the circumstances.

4 Contrary to the above, Criterion V was not met as-evidenced by the following examples:

Pror,edures PT/1 & 2/A/4200/03, NS System Valve Stroke Timing, were inadequate, in that they did not contain instructions for filling and venting nf safety systems related to the Residual Heat Removal System, resulting in a temporary loss of the Residual Heat Removal Sys;em on November 23, 1988.

2s Procedure OP/0/A/6350/08, Operation of Station Breakers, was I

inadequate in that it failed to provide precautions to alert operators of breakcr interlocks, contributing to a partial blackout and temporary loss of the Residual Heat Removal System on November 29, 1983.

Electrical drawing MCM-1399.03-0300-001 was inadequate, in that it was nct properly updated, contributing to a r,ersonnel error and temporary ioss of the Residual Heat Removal System on December 1, 1988.

This is a Severity Level IV (Supolement I) violation.

Pursuant to the provisions of 10' CFR 2.201, Duke Power Company is hereby required to submit a written statement or explanation to the U.S. Nuclear Regulatory Commission, ATTN:

Document Control Desk, Washington, DC 20555 with a copy to the Regional Administrator, Region II, and a copy to the NRC Resident Inspector, McGuire Nuclear Station within 30 days of the date of the letter transmitting this Notice. This reply should be clearly marked as a " Reply to a Notice of Violation" and should include for each violation: (1) admission or der.ial of the violation. (2) the reason for the violation if admitted, (3) the corrective steps which have been taken and the results achieved, (4) the corrective steps which will be taken to avoid fut tieer violations, and (5) the date when full compliance will be achieveo.

If an adequate reply is not received within the time specified in this Notice, a'n order may be issued to show cause why the license should not be modified, suspended, or revoked or why such other action as may be proper should not be taken.
