ENCLOSURE NOTICE OF VIOLATION Duke Power Company Docket Nos. 50-369 and 50-370 McGuire Units 1 and 2 License Nos. NPF-9 and NPF-17 During the Nuclear Regulatory Commission (NRC) inspection conducted on September 24, 1988 through October 20, 1988, violations of NRC requirements were identified. In accordance with the "General Statement of Policy and Procedure for NRC Enforcement Actions," 10 CFR Part 2, Appendix C (1988), the violations are identified below.

A. Technical Specifications 6.8.1 requires that written procedures shall be established, implemented, and maintained covering the applicable procedures recommended in Appendix A of Regulatory Guide 1.33, Revision 2, February 1978.

Regulatory Guide 1.33, Revision 2, February 1978, Appendix A, states that general procedures for the control of modification work should be prepared before reactor operation is begun.

Nuclear Station Modification (NSM) Manual, section 7.8.7, Return to Service, states that prior to returning a system to service personnel training shall be completed, as appropriate.

Contrary to the above, the required administrative requirements were not implemented in that personnel training was not completed prior to returning the low-Tave setpoint circuitry to service following a modification changing the setpoint. The failure to train operators on the modification prior to returning the system to service led to an engineered safety features actuation on July 24, 1988.

This is a Severity Level IV (Supplement 1) violation and applies to Unit 2.

B. Technical Specification 3.0.3 requires that when a Limiting Condition for Operation is not met, except as provided in the asscciated ACTION requirements, within 1 hour1.157407e-5 days <br />2.777778e-4 hours <br />1.653439e-6 weeks <br />3.805e-7 months <br /> action shall be initiated to place the unit in a MODE in which the specification does not apply by placing it, as applicable, in:

1. At least HOT STANDBY within tha next 6 hours6.944444e-5 days <br />0.00167 hours <br />9.920635e-6 weeks <br />2.283e-6 months <br />,
2. At least HOT SHUTDOWN within the following 6 hours6.944444e-5 days <br />0.00167 hours <br />9.920635e-6 weeks <br />2.283e-6 months <br />, and
3. At least COLD SHUTDOWN within the subsequent 24 hours2.777778e-4 days <br />0.00667 hours <br />3.968254e-5 weeks <br />9.132e-6 months <br />.

Contrary to the above, Unit 1 was not placed in at least HOT SHUTDOWN within 6 hours6.944444e-5 days <br />0.00167 hours <br />9.920635e-6 weeks <br />2.283e-6 months <br /> after determining that the Limiting Condition for Operation .

was not met for Technical Specification 3.6.1.8, Annulus Ventilation System, while in HOT STANDBY on October 12, 1988.

Pursuant to the provisions of 10 CFR 2.201, Duke Power Company is hereby required to submit a written r.tatement or explanation to the U.S. Nuclear Regulatory Conunission, ATTN: Document Control Desk, Washington, DC 20555 with a copy to the Regional Administrator, Region II, and a copy to the NRC Resident Inspector, McGuire Nuclear Station within 30 days of the date of the letter transmitting this Notice. This reply should be clearly marked as a "Reply to a Notice of Violation" and should include for each violation: (1) admission or venial of the violation, (2) the reason for the violation if admitted, (3) the corrective steps which have been taken and the results achieved, (4) the corrective steps which will be taken to avoid further violations, and (5) the date when full complioce will be achieved. Where good cause is shown, consideration will be given to extendir.g the response time. If an adequate reply is not received within the time specified in this Notice, an order may be issued to show cause why the license should not he modified, suspended, or revoked or why such other action as may be proper should not be taken.
