Wolf Creek Safety Evaluation for the Increased RdF RTD Uncertainty and Rosemount Transmitter Installation - Wolf Creek Generating Station, Unit 1 By Kansas Gas and Electric Company letter, dated May 31, 1985 and Westinghouse letter, dated May 30, 1985 with affidavit AW-76-60, dated December 2, 1976, you submitted the Wolf Creek Safety Evaluation for the Increased RdF RTD Uncertainty and Rosemount Transmitter Installation / prepared by Westinghouse and dated May 1985. You requested that this report be withheld from public disclosure pursu-ant to 10 CFR 2.790. A non-proprietary version of this report was also submitted.

. You stated that the submitted information should be considered exempt from -

mandatory public disclosure for the following reasons: -

1. The information submitted has been held in confidence by Westinghouse and to the best of your knowledge it is not _ _

available in public sources.

2. Release of the infonnation to the public would jeopardize the competitive status of Westinghouse. The information developed at great expense is of commercial value to Westinghouse and sold to their customers. Public dis-closure of the information would allow competitors to duplicate Westinghouse designs without commensurate expense of time, money and labor.

We have determined that the Wolf Creek Safety Evaluation for the Increased RdF RTD Uncertainty and Rosemount Transmitter Installation, dated May 1985, marked as proprietary, should be withheld from public disclosure pursuant to 10 CFR 2.790(b)(5) and Section 103(b) of the Atomic Energy Act of 1954, as amended.

Mr. R. A. Wiesemann We therefore approve your request for withholding pursuant to 10 CFR 2.790 and are withholding the above described report from public inspection as proprietary. A non-proprietary version of this report has been placed in the Comission's Public Document Room for review by members of the public.

Withholding from public inspection shall not affect the right, if any, of persons properly and directly concerned to inspect the documents. If the need arises, we may send copies of this information to our consultants working in this area. We will, of course, insure that the consultants have signed the appropriate agreements for handling proprietary information.

If the basis for withholding this information from public inspection should change in the future such that the information could then be made available for public inspection, you should promptly notify the NRC. You should also understand that the NRC may have cause to review this determination in the future, such as if the scope of a Freedom of Information Act request includes your information. In all review situations, if the NRC needs additional information from you or makes a determination adverse to the above, you will be notified in advance of any public disclosure.
