Withholding from Public Disclosure - CAW-84-111 - Wolf Creek Low Power and Ascension Test Results Review Program - Wolf Creek Generating Station, Unit 1 By Kansas Gas & Electric Company letter, dated December 21, 1985 and your letter dated, December 12, 1985 and affidavit AW-76-8, dated August 11, 1976, you submitted the Wolf Creek Low Power and Power Ascension Test Results Review Program and requested that it be withheld from public disclosure pursuant to 10 CFR 2.790.

You stated that the submitted information should be considered exempt from mandatory public disclosure for the following reason:

The information enables Westinghouse to justify the design -

correlations and assists its customers to obtain licenses; provide greater flexibility to customers assuring them of safe reliable operation; optimize performance while main-taining a high level of fuel integrity; justify operation at a reduced peaking factor with wider target band than normal, and justify full power operation and meet warranties.

The information gained from this augmented startup program is of commercial value and is sold for considerable sums of money and release of the information to the public would greatly harm the competitive status of Westinghouse by allowing competitors access to infonnation developed by Westinghouse at great expense without the outlay of commensurate expenditure.

Mr. R. A. Wiesemann .g <g 3 g We have determined that the Wolf Creek Low Power and Power Ascension Test Results Review Program should be withheld from public disclosure pursuant to 10 CFR 2.790(b)(5) and Section 103(D) of the Atomic Energy Act of 1985, as amended.

We, therefore, approve your request for withholding pursuant to 10 CFR 2.790 and are withholding the above stated document from public inspection as pro-prietary. A non-proprietary version of this report has been placed in the Commission's Public Document Room in Washington, D. C. and the local public document rooms established for the Wolf Creek Station.

Withholding from public inspection shall not affect the right, if any, of persons properly and directly concerned to inspect the documents. If the need arises, we may send copies of this information to our consultants working in this area. We will, of course, insure that the consultants have signed the appropriate agreements for handling proprietary information.

If the basis for withholding this information from public inspection should i change in the future such that the information could then be made available for public inspection, you should promptly notify the NRC. You should also under-stand that the NRC may have cause to review this determination in the future, such as if the scope of a Freedom of Information Act request includes your information. In all review situations, if the NRC needs additional information from you or makes a determination adverse to the above, you will be notified in advance of any public disclosure.
