We are attaching subject Notices of Deposition for: V,enneth L. Scheppele, ' John C. Finneran, Gary Krishnan, and Peter S. Y. Chang. Although the attached Notices

a' were typed and copies run and hand-delivered to the Applicants' attorney, Mr.

Horin and the four listed Applicants' witnesses this morning at the deposition '

s .,9;, (for Mr. Jack Doyle, I did not have time this morning before the deposition to get copies run for anyone else.

At the deposition today, which was quite lengthy, I completed CASE's examination 4

except for a few follow-up questions about 6:40 P.M. Applicants then began their .

L examination of Mr. Doyle (by Mr. Scheppele). At their suggestion, we went straight through until 10:00, without. even stopping for dinner this evening (moving from the Carrington Coleman offices where one of CASE's members had provided us with a conference room for the deposition, to the Texas Utilities offices which were near-by, when our member's offices closed at 8:00 P.M.). I informed the Applicants that I had the attached documents to get out and they agreed that they would

'"3 w; offer no objection if I indicated the circumstances to the Board and asked the Board's pennission to enter the attached Notices a day later than previously indicated. We therefore ask that the Board grant this request. .

Mr. Doyle's deposition will be completed beginning in the morning at 8:30 A.M.,

followed by the subject-referenced witnesses for the Applicant later tomorrow.

As indicated in the attached Notices, we did not learn of the Applicants' witnesses' names until late the af ternoon of the 16th and were not able to confirm with Applicants until the late afternoon of the 18th (yesterday) which witnesses would be available on the dates requested. We also confirmed the deposition times and places with the NRC Staf f, who indicated they would not,be attending.
