PADUCAll INSPECTION REPORT 70-7001/97-208, NOTICE OF VIOLATION AND NOTICE OF DEVIATION

This refers to the Nuclear Criticality Safety (NCS) inspection by members of the Headquarters staff conducted on September 15-19, and November 3-7,1997, at your Paducah, Kentucky facility. The purpose of the inspection was to determine whether activities authorized by your certificate were conducted safely and in accordance with NRC requirements. At the conclusion of the inspection, the findings were discussed with those members of your staffidentified in the report (Enclosure 3).
Areas examined in the inspecti< 1 are identified in the enclosed report. Within these areas, the inspection consisted of selective examinations of procedures and relevant records, interviews with plant personnel, and observation of activities in progress. Within the scope of the inspection, three violations and one deviation from a commitment were identified, as described in Enclosures 1 and 2, Notice of Violation and Notice of Deviation. The violations concemed the validation of criticality codes at 5.5wt% enrichment, corrective actions in response to surveillance findings, and failure to involve NCS staffin evaluation of upset conditions involving loss of double contingency controls. The deviation concemed changes to a commitment date to correct a previously identified violation. Although no immediate safety hazards were identified, these are of regulatory concern because they concern a lack of rigorous analysis and process to carry out effective and prompt corrective actions and could lead to safety problems in the future. In addition, two unresolved items and six inspector follow-up items were identified.
You are required to respond to this letter and should follow the inst actions in the enclosed Notice of Violation and Notice of Deviation when preparing your response. In your response, you should document the specific actions taken and any additional actions you plant to prevent recurrence. Your response may reference or include previous docketed correspondence, if the correspondence adequately addresses the required response. After reviewing your response to the enclosed Notices, including your proposed corrective actions and the result of future 7
inspections, the NRC will determine whether further NRC enforcement action is necessary to            t ensure compliance with NRC regulatory requirements.
