On October 1 and October 8, 2008, the U.S. Nuclear Regulatory Commission (NRC) and Duke held conference calls to discuss the NRC staffs preliminary acceptance review of the May 30, 2008, LAR to adopt NFPA 805 for Oconee. The purpose of the call was to clarify information provided in the May 30, 2008, LAR and to discuss the supplemental information that Duke will be providing. Enclosed is a list of the participants. The May 30, 2008, LAR is available in the Agencywide Documents Access and Management System (ADAMS) under accession number ML081650475. Prior to the calls, the NRC staff sent to Duke the NRC staffs Preliminary Oconee LAR Acceptance Review Matrix (Matrix), which is available under ADAMS accession number ML082880455. Also, prior to the calls, Duke provided additional draft material to the NRC staff for its review. This material was entered in ADAMS (accession number ML0828803120), but is considered sensitive information per Title 10 of the Code of Federal Regulations, Part 2, Section 2.390 and is not publically available.
The licensee stated in its May 30, 2008, LAR that additional information; including the probabilistic risk assessment, change evaluation, and proposed modifications for non-compliance; will be submitted at a later date. In its letter dated June 30, 2008 (ML081890193),
the licensee stated that the additional information will be submitted by October 31, 2008.
The Matrix contained each attribute that the NRC staff considered in its preliminary acceptance review. The second column in the Matrix indicated whether the May 30, 2008, LAR contained sufficient information for the NRC staff to accept the LAR for review. During the two conference calls, the NRC staff and Duke discussed only those items for which the NRC staff did not have sufficient information, i.e., those with no in the second column of the Matrix. For most of these items, Duke stated that the information will be provided by October 31, 2008.
Following is the discussion of the remaining items, i.e., those items that had no in the second column of the Matrix and for which the licensee did not commit to provide the information by October 31, 2008:
: 1. Item III.3.3, page 21 of Matrix - The NRC staff requested 3 calculations, based on its interpretation of the requirements in NFPA 805 as described in the Matrix. Duke intends to provide 2 calculations, which, Duke stated, is consistent with the Shearon Harris LAR.
The NRC staff conveyed to Duke that there has been additional clarification on the requirements for submittal subsequent to the Shearon Harris acceptance review. The NRC staff requested and Duke agreed, that if all 3 calculations are not provided, Duke

SUMMARY

OF OCTOBER 1 AND OCTOBER, 8, 2008, CONFERENCE CALLS TO DISCUSS THE ACCEPTANCE REVIEW OF THE MAY 30, 2008, LICENSE AMENDMENT REQUEST (LAR) TO ADOPT NATIONAL FIRE PROTECTION ASSOCIATION (NFPA) 805 FOR OCONEE (TAC NOS. MD8832, MD8833, AND MD8834)

On October 1 and October 8, 2008, the U.S. Nuclear Regulatory Commission (NRC) and Duke held conference calls to discuss the NRC staffs preliminary acceptance review of the May 30, 2008, LAR to adopt NFPA 805 for Oconee. The purpose of the call was to clarify information provided in the May 30, 2008, LAR and to discuss the supplemental information that Duke will be providing. Enclosed is a list of the participants.
