On February 25, 2002, the U.S. Nuclear Regulatory Commission (NRC) issued an | On February 25, 2002, the U.S. Nuclear Regulatory Commission (NRC) issued an Order modifying the operating license for the Braidwood Station, Units 1 and 2; Byron Station, Units 1 and 2; Clinton Power Station; Dresden Nuclear Power Station, Units 2 and 3; LaSalle County Station, Units 1 and 2; Limerick Generating Station, Units 1 and 2; Oyster Creek Generating Station; Peach Bottom Atomic Power Station, Units 2 and 3; Quad Cities Nuclear Power Station, Units 1 and 2; and Three Mile Island Nuclear Station, Unit 1 (TMI-1) to require compliance with the specified interim safeguards and security compensatory measures. The interim compensatory measures (ICMs) were listed in Attachment 2 to the Order. When issuing the Order, the Commission recognized that Exelon Generation Company, LLC (Exelon) and AmerGen Energy Company, LLC (AmerGen) have voluntarily and responsibly implemented additional security measures following the events of September 11, 2001, but in light of the continuing generalized high-level threat environment, the Commission concluded that the security measures should be embodied in an Order consistent with the established regulatory framework. | ||

EXELON GENERATION COMPANY, LLC AND AMERGEN ENERGY COMPANY, LLC - REPLY TO RESPONSE TO ORDER FOR INTERIM SAFEGUARDS AND SECURITY COMPENSATORY MEASURES (TAC NOS. MB4098, MB4099, MB4105, MB4106, MB4112, MB4123, MB4124, MB4140, MB4141, MB4142, MB4143, MB4156, MB4161, MB4162, MB4169, MB4170, AND MB4189)
Dear Mr. Skolds:
On February 25, 2002, the U.S. Nuclear Regulatory Commission (NRC) issued an Order modifying the operating license for the Braidwood Station, Units 1 and 2; Byron Station, Units 1 and 2; Clinton Power Station; Dresden Nuclear Power Station, Units 2 and 3; LaSalle County Station, Units 1 and 2; Limerick Generating Station, Units 1 and 2; Oyster Creek Generating Station; Peach Bottom Atomic Power Station, Units 2 and 3; Quad Cities Nuclear Power Station, Units 1 and 2; and Three Mile Island Nuclear Station, Unit 1 (TMI-1) to require compliance with the specified interim safeguards and security compensatory measures. The interim compensatory measures (ICMs) were listed in Attachment 2 to the Order. When issuing the Order, the Commission recognized that Exelon Generation Company, LLC (Exelon) and AmerGen Energy Company, LLC (AmerGen) have voluntarily and responsibly implemented additional security measures following the events of September 11, 2001, but in light of the continuing generalized high-level threat environment, the Commission concluded that the security measures should be embodied in an Order consistent with the established regulatory framework.
The Order required responses and actions within specified timeframes.Section III.A of the Order required licensees to immediately start implementation of the requirements listed in to the Order and to complete implementation no later than August 31, 2002.
Section III.B of the Order required licensees to notify the Commission: (1) if they are unable to comply with the requirements described in Attachment 2, (2) if compliance with any of the requirements is unnecessary in their specific circumstances, (3) if implementation of any of the requirements would cause the licensee to be in violation of the provisions of any Commission regulation or the facility license, or (4) if implementation of any of the requirements described in would adversely impact the safe operation of the facility.Section III.C.1 of the Order required licensees to submit to the Commission, within 20 days of the date of the Order, a schedule for achieving compliance with each requirement described in Attachment 2 to the Order.Section IV of the Order noted that in accordance with 10 C.F.R. § 2.202, the licensee must submit an answer to the Order and may request a hearing on the Order within 20 days of the date of the Order and, where good cause is shown, consideration would be given to extend the time to request a hearing.
J. Skolds In letters dated March 15, 2002, (letter nos. RS-02-055 and RS-02-056), Exelon and AmerGen submitted a response to the Orders for the aforementioned power plants. The letters are being treated as a request for an extension of time until June 20, 2002, to respond to ICMs B.2.a(1),
B.2.a(1), B.2.a(2), B.2.b and B.4.i and as a request for a comparable extension of time to file a request for hearing for those matters.
The NRC staff has reviewed the response and finds that Exelon and AmerGen have satisfied the 20-day reporting requirements of the Order, with the exception of ICMs B.2.a(1), B.2.a(2),
B.2.b, and B.4.i. An extension of time is hereby granted until June 20, 2002, for submission of the required response to the four remaining ICMs. An extension of time is hereby granted until June 20, 2002, for Exelon and AmerGen to file a request for hearing related to ICMs B.2.a(1),
B.2.a(2), B.2.b and B.4.i.
There are two instances in which the responses to ICMs are still under review. The first issue is the response to ICM B.4.e which will require additional correspondence from you to resolve.
The issue applies to each of the operating sites. We understand that you intend to submit such correspondence within several weeks. Accordingly, we will continue our review of the response to ICM B.4.e upon receipt of the supplemental response.
The second issue (B.1.c) applies to TMI-1 only. Resolution of the issue will require additional communication between the NRC and AmerGen staffs. Because there are the two unresolved issues for TMI-1, the staff will send a separate letter addressing the response to the Order for TMI-1.
The NRC will determine the effectiveness of Exelons and AmerGens implementation of the ICMs through on-site inspections. I would like to remind you that, pursuant to Section III.C.2 of the Order, Exelon and AmerGen are to report to the Commission when full compliance with the requirements described in Attachment 2 to the Order has been achieved. Furthermore, continued communications and review of the two open issues discussed above will not be a basis for an extension of, or relief from, the requirement to achieve full compliance with all requests of the Order no later than August 31, 2002.
