Dear Mr. Pacilio:
This letter acknowledges three letters you sent to the U.S. Nuclear Regulatory Commission
(NRC), two letters dated September 1, 2010, and one letter dated September 2, 2010, which
provide a response to our inspection report issued on August 3, 2010, concerning activities
conducted at Clinton Power Station. The three letters you sent each contested a separate
Non-Cited Violation (NCV) contained in the inspection report. The contested NCVs are:
05000461/2010003-01 Failure to Satisfy 10 CFR 50.72 and 50.73 Reporting Requirements,
05000461/2010003-02 Failure to Perform an Adequate 10 CFR 50.59 Evaluation for CPS
Procedure 3711.01, and 05000461/2010003-04 Inadequate Emergency Plan Augmentation
Call-In Drills.
We are currently reviewing your basis for contesting the above NCVs. The NRC seeks to be
thorough and timely in the review of licensee responses to NCVs. Accordingly, we will inform
you as soon as we complete our evaluation.
In accordance with 10 CFR 2.390 of the NRC's "Rules of Practice," a copy of this letter will be
available electronically for public inspection in the NRC Public Document Room or from the
Publicly Available Records System (PARS) component of NRC's Agencywide Documents
Access and Management System (ADAMS), accessible from the NRC Website at
