SUIT TO PREVENT RESTART i On July 31, 1986, the Village of Seneca, Illinois, filed suit against the Nuclear Rigulatory Commission in the U.S. Court of Appeals for the Seventh Circuit (Chicago),

sceking to prevent the resumption of operation of the LaSalle Nuclear Power Station, f l

[ Both units are currently shut down. Unit 2 has been shut down since June 1, 1986, as a l

result of problems with reactor water level pressure switches (Reference PN0-III-86-52, 52A l and 52B). Unit 1 is shut down for refueling and modifications. The licensee plans to restart Unit 2 on August 7; Unit I would be restarted about September 1, 1986.

Under a Confirmatory Action Letter, issued June 2, 1986, in connection with the water level ,

pressure switches, the concurrence of the Region III (Chicago) Regional Administrator is {

r:ouired before either unit may resume operations.

The Village of Seneca previously announced on June 17, 1986, that it was withdrawing from emergency planning activities for LaSalle (Reference PN0-III-86-58).

The suit cites alleged shortcomings in emergency planning activities for the LaSalle plant and the plant's " troubled performance record." The Village had previously filed a petition under 10 CFR 2.206 seeking to institute a proceeding to revoke the LaSalle Operating License for lack of an adequate emergency plan and, in the interim, to prohibit resumption of operations of the plant.

The State of Illinois will be notified of this information.

Region III (Chicago) was informed of the filing of the suit at 9:00 a.m., August 1,1986.
